Hi,

My wife is green card holder. She give birth abroad in India. Now how to bring my child with the mother to USA. Can someone help me. What is the process to bring my child.

Are you a US citizen? If yes, your wife can file Consular Report of Birth Abroad (CRBA) at the US Embassy in India so the child can get a US passport (and of course US citizenship).

If that don't work, you need to file i130 for the child. As green card holders, the child will be under F2A category. I guess you know the drill already unless you can naturalize soon.

Why didn't you figure out how to bring your baby to the U.S. before your wife left the US on her green card to have the baby abroad?

I am a legal permanent resident of the U.S. While I was outside the U.S., I gave birth to a child. Now I wish to return to the U.S. May I take my child with me?
As outlined in 9 FAM 42.1 N1.1, a child under two years of age who was born of a Permanent Resident Alien mother during a temporary visit abroad does not require an immigrant visa in order to travel to the United States if the alien parent is in possession of a valid Form I-551 (i.e. green card), a valid reentry permit, or an SB-1 visa. The child must be admitted to the U.S. within two years of birth and the accompanying parent must be applying for readmission upon first return after the birth of the child. We suggest that the accompanying parent carry documentary evidence of his or her relationship to the child, including the child's passport and birth certificate.

It's great that someone gave you a link to find this answer. But why didn't you try to find the answer before your wife left to have the baby abroad?Wouldn't a little preplanning have been a good idea? What if there was no procedure to allow the baby back? How long has your wife been outside the USA?

If she's been abroad for 6 months to 1 year she may have issues re-entering. If she's been abroad over a year she will have to get a Re-Entry Permit.
