I 130 how to correct a mistake?

Hello everyone,

I am the beneficiary and my husband filled petition for me in September. We have got a NOA1 on 1st Oct, but after almost 3 months I was going through our papework again and found out that we had made a mistake in question 17 under section C: List husband/wife and all children of your relative. Instead of listing my husband, who is the petitioner, we have listed me - beneficiary, which is a obvious mistake :( Should we send corrected form with explanation or rather wait for RFE maybe?

I wilk appreciate any advice:)

Line 17 is for the beneficiary's information which is you and not your husband.

if you don't have a baby, then it should be only your name that will be in C - 17.

Your understanding is the same as mine and that is how mine looks. It says on the form to list the spouse and children of your alien relative. The petitioner is the one answering this so you are correct because the petitioner is also the alien spouse.

I am the beneficiary. My husband is the USC. So for my form it listed my husband and my two children.

On my children's forms it is blank because they don't have a spouse or children.

I don't know if they will correct it or if they will send RFE for it. They may do nothing at all. You can try to call.

You just did it right.

Line 17 is for the beneficiary's information which is you and not your husband.

The beneficiary's spouse and children need to be listed. So the name of the spouse is the same as the person completing the petition. It just so happens to be the same person but if it was a parent sponsoring a married child it would be the name of that child's spouse.

Line 17 is for the beneficiary's information which is you and not your husband.

if you don't have a baby, then it should be only your name that will be in C - 17.

you name and listed as wife.

These posts are not correct, OP's husband's name should have been written there.

OP, it's 50/50 that they will either overlook it or issue an RFE.

so now I'm sure we've made mistake. Should we send corrected form? May it cause any delay? I wanted to avoid any RFEs, but now I don't what is better - just wait and hope they won't notice that mistake or try to do something with that. Any advice?

Sending a corrected form at this juncture will most likely be nothing more than an exercise in futility because it's highly unlikely it would get matched with the file.

As Ryan said, it likely won't get matched up with your original file anyway so probably pointless. You can wait to see what happens and respond accordingly. My guess is that a lot of people make that mistake. The other person who responded to your original post obviously made the same error and got through to his/her interview per their timeline. I would wait it out.

That’s just how our paper is and we didn’t got any problem with it, in fact our I-130 was approved.

The adjudicator who reviewed your husband's petition overlooked the error, the form was not filled out correctly. I can't speak to how common this error is nor can speak to how often it is overlooked or not.

The bottom line to others who will read this thread is this, fill out the form correctly to avoid unnecessary delay.
