My daughter will be born after we submit the I-130... What do I need to know?

Hi All,

I'm filing for the CR-1 ... starting with the I-130 form and the G-325A... It is for bringing both my wife and my two step kids from Australia to America.

My wife will be giving birth to our own daughter in about two months... however we will have already submitted the I-130.

What will we need to do to have an update made, but without throwing a wrench in the system and causing the visa process to extend in length?

The sooner we can be in America the better, which is why we are not going to wait until our daughter is born to start the process.

Push thru with the process. You can then file for CRBA, consular report of birth abroad, for your child at the same time apply for the passport for your daughter.

Thats what we did. Our mistake was not applying for visa for me ;(

You dont need to include your child to the petition, provided you qualify for the crba. Read more on this process

If you had ever lived in the US for a minimum of five years as a USC', then your baby will be eligible for CRBA otherwise ineligibility sets in. Read more on criteria for CRBA

not 5 years as a US citizen. Say for example you became a citizen last year, you can count the 4 previous years as a permanent resident. The 5 years are residential status not immigration status. So if you have 5 tax returns or w2s you should be good to go.
