Hello everyone! This is my first post! I have a few questions I'd like answers to. I was hoping to find them here! Let me tell you a little about my situation. I am a US citizen and my husband is an Indian citizen.

I filed form I 130.

They asked for two passport sized photos of me (petitioner), copy of our marriage certificate, and form g325a for my husband (beneficiary).

USCIS denied my case because I forgot to submit my marriage certificate. I was told I could appeal within 30 days.

I did appeal. I filled out form eoir-29 along with my marriage certificate and a check of $110.

They mailed back the form eoir-29 along with my marriage certificate and a reason as to why they didn't accept my form.

I called customer service and was told that I had made the check payable to the wrong person/place.

When asked why they didn't return my passport sized photos or form g325a, my call was redirected. The lady told me to correct my mistake and send back everything along with my marriage certificate and a cover letter asking to keep processing my case since it's been over 30 days.

My first question: Since they didn't mail my passport sized photos or form g325a back, does that mean they accepted them?

My second question: Regarding my first question, should I send NEW passport sized photos (because photos void after 30 days) and a new g325a form if they did not accept them?

Third question: How do I go about writing a cover letter? I have to ask them to continue processing my case. Even though it has been over 30 days, I did initially appeal within 30 days time.

Last question: Even though the lady told me to send everything back to the same address, (it was a p.o. box in Dallas), do I send the cover letter there as well?

I'm so confused! Please help me! Thank you!

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

First of all, filing an appeal was a waste of time, since you had forgotten include a copy of the marriage certificate in the inital filing, denial of the petition, while extreme (they could have issued an RFE but chose not to do so) was proper. You had no grounds for an appeal and it appears that the appeal was rejected despite what you may have been told over the phone (the USCIS phone line is often called the misinformation line on VJ for a reason, the people you talk to are notorious for giving out bad information).

IMO, just forget about what was previously submitted and start over from scratch. New forms, new pictures, copies of required documents, and a new filing fee.

Maybe I should have included this: I received a notice saying they accepted the appeal and that it was in process. How long does the process take?

UPDATE: I just received the approval of I 130 on February 23. I called customer service and was told to wait for another notice with instructions from NVC. Can anyone tell me step by step what happens next?

Congratulations on your I-130 approval. Next step will be NVC (You will focus on NVC now. You will no longer focus on USCIS since it was approved and it is now being shipped to NVC).

Priority dates mean nothing when a US Citizen is petitioning an immediate relative, in these cases, all the priority date reflects is the date the petition officially enters the queue at USCIS.

Priority dates are relevant for numerically limited visa categories. Since spousal visas are not in a numerically limited category, it is not applicable to you.

Ok, so I just checked the USCIS website. My case was sent to the Department of State for visa processing! What should I expect in the upcoming days?
