Hi,

It has now been 56 days since my husband's first NOA for EAD. We have not received a biometrics appointment letter and I am getting worried. I understand that after 90 days he is able to get an interim EAD; however according to our local office (Hartford) they are processing applications with Feb. 1, 2006 day. Can I schedule an INFOpass appointment now or should I wait until the 90 days are up?

Or maybe the more proper question should be:

Which processing dates should I refer to: NSV or my local office? Which ones are more relevant?

You have to work off the NOA date. The processing dates posted by the local offices are often out of date and not a good gauge of how things are progressing.

Whatever the received date is on your Husbands NOA is the date you should start your count from. On day 91 you are allowed to ask the USCUS for an interim EAD. if you haven't had biometrics by then then they'll probably allow you to do them on the same day. You can make an infopass appointment now for an advanced date but make sure that the date you book is on or after the 91st day from your hubbies NOA date. Any sooner and they won't even discuss your case with you !!
