Timeline

Hello,

I've been trying to gather as much information regarding the AOS as possible. I had read the instructions for the I-131 but it states that you can apply for AP for specific purposes only (humanitarian purposes, schooling, work etc.). However, when I read the forum sometimes, I get the impression that people are applying for AP for other purposes, like traveling for leisure. Am I reading the instructions incorrectly? Should I not bother applying for AP unless under those specific reasons? Or is it possible to apply for and be approved for AP under circumstances in which someone is not ill, deceased, working abroad, going to school abroad, etc.?

You are confusing Advance Parole, which anyone with a pending adjustment of status case is eligible for, with Humanitarian Parole, for which you need specific reasons in order to be approved.

Yes, I am definitely confused. I think you may be un-muddling it for me though. I think where the confusion was, was the instructions. The "Who May File Form I-131?" part only mentions the aforementioned circumstances. However, I do see in "General Requirements" part, to submit a copy of the I-485 (or in this case, submit them together). The instructions seem to blur everything together.

My main concern is if the AP can be applied for and approved without those stipulations. So, if AP is applicable to all members who applying for AOS, fantastic! Thank you for helping me. I just had one more thing regarding the application. In it, it requests a date of intended departure. What if you don't have one? Should it be left blank? Or should you enter in a date with the best of intentions and if you don't leave on or around that date, will there be issues?

You can enter "Unknown" if you have no firm travel dates set.

Timeline

Advance Parole for adjustment applicants requires no reason or explanation for wanting/needing the AP. You can travel abroad for leisure and re-enter the US with your AP.

Leave the date and length of trip blank, then hand-write 'Unknown' after printing out the form.

You, yourself Hypnos, posted to me the general rules for AOS applicants which are:

On the I-131 instructions, page 4, section (3)(a)(1):

"You have a pending application to adjust status, Form I-485, and you seek to travel abroad for "urgent humanitarian reasons", or in furtherance of a "significant public benefit", which may include a personal or family emergency or bona fide business reasons".

And further, applying for AP without giving reason or dates, and even getting AP, is not the same as being able to use AP for any reason.

July 24, 2017  ROC packet signed for in Vermont.

August 8, 2017  NOA received at house.  15 days since ROC signed for in VSC.

August 25, 2017 BIO completed. 32 days since ROC received in VSC.

August 11, 2018  18 month 'Courtesy Copy' extension letter received.  Critical number  297

December 4, 2018  USCIS Account shows: We approved your Form I-751, Petition to Remove Conditions on Residence, 

December 4, 2018, ordered your new card for Receipt # EAC17297003XX, and will mail to the address you gave.

491 days from NOA issued by VSC until Petition approved.

December 7, 2018 USCIS sent notice:  Card mailed.

December 12, 2018 Ten year Green Card received from Lees Summit, MO

499 days from NOA issued by VSC until Green Card received.

December 8, 2018 received notice on USCIS that Biometrics scheduled . . . but the actual date was not yet shown.

December 11, 2018 saw in 'Documents' section of USCIS that Bio scheduled for 24 December 2018.

December 21, 2018 saw on USCIS website that they will be closed 24 December 2018 as extra holiday.

January 9, 2019 went for re-scheduled BIO appointment.  33 days after N-400 submitted on-line.

February 19, 2019 received letter in US mail that Citizenship interview scheduled for 26 March 2019. 74 days after submission on-line.

March 26, 2019 Citizenship interview scheduled for.  109 days after N-400 submitted on-line.

March 26, 2019 Passed Citizenship interview.

April 12, 2019  Received notice that Oath Ceremony had been scheduled for 24 April 2019.  17 days after interview.

April 24, 2019  Oath Ceremony completed.  29 days after interview.     139 days after N-400 submitted on-line.

April 25, 2019  USA Passport Application submitted.

May 3, 2019     USA Passport received.    149 days after N-400 submitted on-line.

May 9, 2019     Certificate of Naturalization and Citizenship returned in mail.

Why are you spamming all the posts about AP you can find with this same thing, all while ignoring all the posts from people in the thread you started on this topic(and others you spammed this in) telling you that using AP for any reason as an an adjustment applicant is already tried and true?

You can obtain AP to re-enter if you have filed for AOS and are still awaiting approval, and/or if you need to travel for for an emergency or some other bona fide reason. You can use AP if granted because you are an AOS applicant, or if you need it for some specific reason. It does not have to be both. You do not need to have an emergency As an AOS applicant, you never need to give a reason for wanting/needing to use AP. : http://www.cbp.gov/travel/international-visitors/lpr/adv-parole

Aliens in the United States should, prior to departure, obtain Advance Parole in order to re-enter the United States after travel abroad if they have:

  • Filed an application for adjustment of status but have not received a decision from the U.S. Citizenship and Immigration Services;
  • Hold refugee or asylee status and intend to depart temporarily to apply for a U.S. immigrant visa in Canada; and/or
  • An emergent personal or bona fide reason to travel temporarily abroad.
