Hello all,

I just wanted to clarify something for the i-864. I as the sponsor will be filling this out as soon as my fiance gets her K1 visa. She already had the interview and is just waiting for it to come in the mail. Her approximate ETA will be this March 2015. Anyway, I wanted to get on the ball and started doing some of the needed paperwork for her to adjust status as soon as we get married in March. I was looking at the i-864 and was confused by a part of it. I hope you can help me.

Now I, as the sponsor, am filling out the i-864. For Part 5 (Sponsor's Household Size), it says that we should NOT COUNT ANYONE TWICE. For number 1 of Part 5 it says to enter the number you entered on line 7 of part 3. In that part I entered "1" (for my fiance who I will be marrying in March and since she is the "Principal immigrant" I am sponsoring using this form). However, for number 3 of Part 5 it asks "If you are currently married, enter "1" for your spouse." Now granted, all the parts after number 1 in Part 5 say "Persons NOT sponsored in this affidavit", so parts 2 to 7 are under that heading. Number 1 of Part 5 is under the heading "Persons you are sponsoring in this affidavit".

So am I supposed to leave number 3 of Part 5 as "zero (0)" since I already put "1" under "Persons you are sponsoring in this affidavit"? I read the instructions and am inclined to think so based on the information they gave. Since she will be my wife, but I AM sponsoring her using this form, I should just leave number 3 of Part 5 blank, correct?

Also, the instructions for i-864 tell me to put my current individual annual income from number 5 of Part 6 into the "Current Income" box of 6.c. Does that mean I have to fill in the "Name" and "Relationship" part of 6.a. and 6.b. under the Person 1 heading in Part 6?

Sorry, these are very technical questions. It's just the instructions are somewhat ambiguous and I want to make sure there are no mistakes. If anyone could give some guidance I would appreciate it. Thank you.

The instruction that states DO NOT COUNT ANYONE TWICE is the biggest one you need to follow. So yes, you are supposed to leave number 3 as ZERO if you count your spouse in number 1.

Numbers 6 - 9 of Part 6 are referring to OTHER people who reside with you that are combining their income with yours. If this does not apply to you, then you just leave it blank.
