Hi, sorry for my lack of knowledge about it but I was just wondering how they judge if you entered the US on a tourist visa with or without intentions to get married? Especially if you came to visit somebody that you already had an relationship with!

I don't understand too much about it and was just wondering. For instance, my B2 allows me to stay for 6 months so if I get married something around 1 month before my permitted stay it would be okay and then I would have to go back to my country and then filling for AOS or could I stay there while waiting for the adjudication?

PS: Not saying I will try or encourage people to do it, just being curious!

I came here on a waiver visa. My intent was just to meet with the guy but he proposed to me! and now i have overstayed. Is there anyway i can renew a waiver visa?

You are making this too complicated !!

1) You are here and married

2) You can adjust status, but you MUST stay here until the AOS is complete -- typically 4 - 6 months

3) And then you will have your green card and all is well

Hello,

I have been in similar circumstances. It is not possible for you to renew a visa, so you have the choice of:

  • going back to your home country and have your USC spouse file an I-130 for you, or
  • Stay in the US and file for a concurrent filing of I-130 and I-485 to adjust status and obtain a Green Card

I went the latter way. The cost for this is roughly $2,000.00 and it takes between 4 and 6 months to obtain a green card, provided you are accepted.

You have to file for AOS!

Don't leave the country and about your question you can't renew your ESTA.

Read the guides here in the forum for all the forms and how to do everything... If you don't understand something ask people will help you but read the guides first.

If he is active duty Navy there is free assistance through the JAG offices. They will assign a lawyer to complete the paperwork and answer any questions. No cost so you may as well use it. There may even be some fee assistance. Its a great resource.
