Hello,

I am posting here hoping to get some advice for a friend of mines all help will be highly appreciated. My friend and her husband file for cr1and interviewed in December where they received a 221g on the basis that the marriage was fraudulent because after the marriage she had not visited for 3 years due to financial issues. She has contacted her congressional office to get involved but I'm sure how helpful that would. Thanks in advance I know the member here are always so helpful.

Your friend needs to hire an extremely good lawyer who is familiar with appeals of this kind and also she needs to go visit her husband ASAP.

This PDF document lists all FREE legal aid providers in Miami if your friend cannot afford a lawyer.

Also PS, 3 yrs of marriage and no visit from either one is a BIG red flag. I am engaged and I was self employed all of last year and earned very little but I opened a credit card with 0% interest rate, purchased the flights with that, and am slowly paying off that balance. My fiance borrowed money when he came up short and then was able to visit me. I'm sorry if this sounds harsh but, when there is a will, there is a way.

I wish your friend the best of luck with the appeal and hope she can be reunited with her husband!

I doubt the 3 years of not seeing each other was the only problem.

As long as they were able to provide continuous communication and proof of relationship.

A lot of couples, like me, has not seen our spouses for years. Financial problem is a big factor (maybe).

Thats why the petition is being filed to be reunited.

Maybe OP, your friend has other reasons.

What advice? there's so much information that's needs to be provided like

  1. Did they have Red Flags?
  2. What evidence did they send in or take to interview?
  3. So if she had financial issues and couldn't visit did she have to get a joint sponsor.
  4. Does she have kids.
  5. How long ago did they meet?
  6. When did they marry after meeting?
  7. How long did she stay after wedding?
  8. And you say she hasn't been back since wedding?
  9. Has she or he been married before?
  10. Has he been petitioned before?

Nope that's what was told to the congressional office that inquired about the case. The problem is she did not file a front loaded application thinking she would be able to provide these thing during the interview. The didn't want to accept anything from her at the interview.

What advice? there's so much information that's needs to be provided like

  1. Did they have Red Flags?

First of all no kids neither has been married. He has never been petitioned for and yes she did get a joint sponsor. Basically the person that filed for her she didn't advise her properly informing her that a lot of the evidence of real relationship can be submitted at the interview and when she got to the embassy they weren't accepting them.

There are so many things that could be asked or said about this, BUT, the main thing is, "three years and no face to face contact".,.,I would have worked on a slow boat to Cebu, Philippines, to get to my K-1 visa, now wife, if there is a will, there is a way.

So many unknowns, but the 3 years apart, is a huge deal to over come.

This grievous oversight can sometimes be overcome (with great difficulty and pain), or it can be fatal to the petition. NEVER underestimate the consular phase of the process, and neutralize it as much as possible during the petition phase beforehand.

Hindsight...

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Okay, a lot of you have really good questions about why she hasn't visited but... Why hasn't he visit her? I think both should have put more effort into going to visit each other.

Really? A Haitian won't get a tourist visa easily so makes sense the wife would be coming to Haiti from the US.

That's for sure because I've been trying to get my fiancé a tourist visa while we wait for the K1 and they was not having any of it. In Haiti getting a tourist visa is next to impossible.

The problem is she was badly advised I believe that had she submitted all of her info such a wedding picture call log and etc it would have made a huge difference but the person who file the application told her she could go ahead and file and she have the supporting documents at the interview. Bad advise. So now I really don't know what help I can offer her.
