Hi There,

Currently I work for a UK branch of a US based company.

MY fiancée has opened an application for a K1.

My question is regarding employment. Lets say I get approved, I have 2 options:

- For sake of simplicity, move with my current company to one of their US offices (will this require a new visa?)

- If this cant be done, even if I wanted to move to a new job in the States, this would not be immediate. In this scenario, is it definite, that if I don't move with my current employer, there will be a period of unemployment?

Thanks
Lev

One way or the other, there will be a period of unemployment. On the K1, you cannot work until after you:

1. Are married in the USA

2. Have filed for AOSand

3. Received EAD (which takes 2-3 months after filing AOS).

If being able to work immediately is important, get married somewhere and file for the CR-1 spousal visa, which gives an immediate greencard upon entry and with that, the ability to work and travel. Or, if your company is willing, have them file for a work visa

Thanks for your reply. Im assuming company will not move me and we want to get married in the states which means I have to be prepared for a couple of month minimum unemployment
