Green Card issued but not delivered

Dear All

I have an weird issue

I had my AOS approved last year (June 13 2014), however, my GC was never delivered. I contacted USCIS and following there instructions applied for a replacement, however the replacement was denied. I have had a GC Stamp placed in my Passport, but this expires in October.

I Originally applied for AOS following my K1 Visa in July 2013.

Any advice as what to do. My wife suggests applying to remove conditions in the next few months as this will be the 2 year mark following the AOS application. But is removing conditions after 2 years of owning a GC or after 2 years from AOS?

Please post your suggestions.

Did you ever get the tracking number? Did it show as delivered? Presumably you didn't pay the I-90 fee?

Sorry but you have to pay the fee of $450 for I-90, there is no way around.

Yes I got the tracking number it is shown as delivered, but I was home the entire day and got no mail that day. I spoke with a Teir two person and they instructed to not pay the fee.

Unfortunately if it shows as delivered, even if not to you, you have to pay the I-90 fee for a replacement.

At this point you have two choices:

(i) File a new I-90, this time including the application fee, to obtain a replacement.

(ii) Wait until RoC (you will be eligible to file in March 2016) and just keep getting I-551 passport stamps to show LPR status until then.

I don't think you should have to pay for a replacement for something that was clearly not your fault, but USCIS disagrees. I personally would go with (ii) just to stick it to them and reinforce this point, but the choice is yours.

that wasn't the question, he never asked about the fee, he just wants his green card. And it isn't true. There is a tracking number with the original green card, if he can prove that it was delivered to someone else in error there is no fee.

OP I would make an info pass at your local USCIS office and talk to someone in person. It's been 8 months since the green card was supposedly delivered and you still don't have it. Talk to someone in person.

Unfortunately not. The I-90 instructions state that if the green card was not returned to USCIS as undeliverable then a fee is required for the I-90.

Nancy was right, it is clearly you never dealt with missing uscis mail.

For ROC, you need to supply a copy of your green card, front and back. Not sure how that would go with the temp I-551 stamp being all you have. You may need to pay the fee for the replacement. They may also tell you to apply for a replacement when asking for a new temp stamp.

I just posted something about this same topic yesterday... The same thing happened to my husband's green card - stating it was delivered, but we didn't receive it. Also, I was told we have to pay the $450 to get a replacement b/c their records show it was delivered.

He entered the US on Nov. 8th, 2014. They said the card was delivered Dec. 24, 2014. I called them on Friday (Jan 23, 2015) and spoke to a "Level 2" person and that's who told me I'd have to apply for a replacement card and pay the fee.

Questions for you...did you receive your SS card? (We have not received this.) Also, are you saying that your request for a replacement green card was denied, or the replacement without a fee was denied?

I'm pretty frustrated with the whole situation... And was hoping someone on this forum who has experience could provide some feedback. Thanks for any feedback! Kelly

I spoke with a Tier 2 they told me to apply without the fee. This was declined, I went to a field office and got a I551 stamp
