Hi everyone,

I am new here. I am petitioning both of my parents to US. I have paid AOS fee and filed out DS-261 forms online. I have a few questions regarding filing out I-864EZ. Thanks a lot for all your helps in advance.

1. Which form should I use? I-864EZ or I-864? I have red the instruction for I-864EZ which are listed below. I wrote answers and questions in blue.

a. I am the petitioner of the family member sponsored on this form. Yes i am

b. I am using only my own earned or retirement income, which is documented using IRS Form W-2.

Yes, I have had current job about half a year since July 2014 and my earned income W-2 has already above the 125% of the HHS poverty guidelines. So my 2014 Tax return will be above 125% for sure, but i have not filed 2014 yet. My 2013 income also was all based on W-2s and total above 125%. However, in 2012, I had both W-2 and 1099 and total income slightly below 125% about $500. And I have assets in my bank account.

For above situation, do i qualify to use I-864EZ? do I still need to provide the 1099 for 2012? Since my income in 2011 was slightly under 125%, Do i need to provide documents for assets? Can i just use my currently income (W-2) to petition my parents and don't show 1099 and assets(because my current income is enough for them)?

c. The sponsored immigrant is the only person immigrating based on the underlying Visa petition.

I am petitioning my dad and mom on two separate Visa petitions simultaneously. so they most likely go to interview together at the same time, but again they are on two separate Visa petitions. Am I qualify for C?

2. As for household size for HHS poverty, I understand I don't count my dad on my mom's I-864EZ/I-864( same to my mom). So on each I-864EZ/I-864, the household size is 2, right? (I am single). So is that mean for each I-864EZ/I-864, I need $19,662 for Household size 2, right? But what is the total I need for my parents $19,662*2=$39,324, or $19,662 for 2 people or $24,737 for 3 people? Hope you did not get confused about these numbers.

Any information and help is much appreciated. Thanks a lot.

Thanks for your help. Do you know if I had 1099, but I am using my W-2 to petition my parents, do I qualify to use I-864EZ? Best luck to your cases too. :)

I am in the same boat as you. I think the EZ form should be good, that is what I will be using for both parents. But you can verify with the experts on here.

Mom's I-864EZ:Me=1 Mom=1 total=2

Is that correct?

125% of household size 2 is $19,662. So i should write $19,662 on each of their i-864ez, right?

However, since I petitioning both of them. How much do I need to make? $19,662 or $24,737? If I make $20K, is it enough to petition both of them? I mean when they go to interview, the officer will only consider $19k for each parent or consider two parents together?

I think as long as your income can cover both parents and yourself, you should be fine.

I would make sure I have enough income to cover a household of 3. Regardless if it's two separate petitions, they both would be living with you simultaneously.

You have to put how much you make per year on the required line and proof to back it up. I hope this helps, I am eying to figure this out as I go along.
