Nov 2.....AOS/EAD NOA date-rec'd Nov 4 via USPS.

Nov 4.....Checks cashed/Touched (AOS/EAD).

Nov 12...Rec'd AOS bio appt notice.

Nov 23...AOS Biometrics They also did EAD as I had my NOA, Sioux Falls, SD.

Dec 30....Rec'd AOS Interview Notice

JFK is one of the only (possibly THE only) airports that give the stamp. Bear in mind that you cannot work without a Social Security Number. Once you are here, it takes about two weeks for you to be entered in the SAVE system, then go file for your social security number. Another few days to few weeks later you get ssn then you can work for about two months. Providing you file for AOS as soon as possible, you may only be out of work in between times for about a month. My fiancee came in through JFK and they issued the temp EAD before she even asked for it. Remember you also need your social to work. My fiancee got hers in 3 weeks.

My now wife got the EAD stamp on her I-94 when arriving at JFK airport. She already has a job and is working with her SSN. I was planning on sumitting her I-765 while filing the I-485 but I'm not sure if what happens after the 90-day expiration of her EAD stamp. Can she continue to work since the I-765 is filed? I'm a little confused as to how I can guarantee that she can continue to work. Any help would be greatly appreciated.

Your wife will technically have to stop working as soon as her temp EAD expires. She can begin work again upon receipt of her EAD card. There is no guarantee that there will not be a gap in between these two dates. You will increase your chances of no gap if you file for your AOS and EAD immediately.

Okay, I have to ask. What is the penalty if she continues to work?

In theory, you could be deported and banned from the US for some period of time. Probably not likely though. Your employer stands to get in a lot of trouble too, so they will be sure to fire you before the EAD expires. Some of my friends who manage retail stores go through this a lot - while their employees are waiting for new green cards and EADs, they need to fire their employees and re-hire them when the cards show up.
