Ok, I'm filling out all the AOS paperwork and I have a question about the I-864. On page 11 of the document there is a checklist that says you must submit: "A copy of your individual Federal income tax return, including W-2s, for the most recent tax year ....Also inclue a copy of each and every Form 1099, Schedule, and any other evidence of reported income."

Ok.. help a non USC figure out these terms please ....

1. We have the transcripts that were ordered from the IRS for the I-134. Are these the 'individual Federal income tax returns' or the 'Form 1099s'?

I found the following information in the pinned threads:

In order to complete this form you must submit the following evidence of income:

~ A copy of your complete Federal income tax return, as filed with the Internal Revenue Service, for the last year (see note 1). If you were not required to file a tax return in the most recent tax year, you must provide an explanation. If you filed a joint income tax return and are using only your own income to qualify, you must also submit copies of your W-2s for the last year, and if necessary to meet the income requirement, evidence of other income reported on your tax return, such as Forms 1099.

2. Does this mean that no W-2s are needed as the sponsor did NOT file jointly? Or are W-2s needed anyway?

3. Also, the 'most recent tax year' that we have documentation for is 2005 - is this sufficient? Nobody has anything for 2006 yet.

Thanks for your help with my inane questions.

I believe if you read the instructions further you will find they say if you are using transcripts (rather than an actual copy of the filed return), the 'attachments' - ie W2's, 1099's etc are not required.

There is, however, anecdotal evidence of RFE's for not including the attachments with the transcripts.

So I would send them.
