Hello to all.

As I am new to the website so i didnt know where to start so i made a new new topic hopefully it would be helpful one not only for me but for others as well.

Me and My wife have applied for IR1/CR1 visa. She is from US where as I am from Pakistan. We submitted out Form I-130 for on 28th August 2014 in Nebraska Center and got its receipt on 03-09-2014. It is almost five months since we got our Receipt but nothing else I also keep visiting the website for checking up the status but it shows the same old message. "On August 28, 2014, we received your Form I-130, Immigrant Petition for Relative and sent you the receipt notice that describes how we will process your case. Please follow the instructions in the notice. If you do not receive your receipt notice by September 27, 2014, please call Customer Service at 1-800-375-5283. If you move, go towww.uscis.gov/addresschange to give us your new mailing address."

My question is that should i be worried that my petition haven't yet got approved. Should I call their helpline or wait for a bit more?

The normal time line for processing the Petition form I-130 is 5 months so what could be the reason for delaying approval of my petition?

In case if due to any reason it gets denied for approval do i have to submit all the fees again and have to wait again for 5 or more months till it get approved?

It will be 5 months on 28th jan. since you filed the petition. though the processing times state 5 month but usually it takes more time. after 5 months you can file an e request. For males specially young male they take more time in security checks etc. i applied for my parents. it took 5 and 1/2 month in my mom case and 8 months in my dad case. I dont think you should worry and as for denial is concerned it is rare. they may however ask for further evidence which they did not so far. Wait patiently you will get approval soon.

Oh Okie Kausar bhai thank you for replying so it is normal routine procedure that they usually require more time to approve petitions of younger males. Actually I got worried after reading few of the cases on this website which were processed so quickly for e.g they got their I-130 receipt within few days they submitted the fees and then it got approved within one month and the case was sent to NVC for further processing. Ill try not to panic now because your words really provided me peace of mind so thank you :) Hopefully it gets approved soon.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Few of the cases you are referring which got early approvals are from the countries which have been given special status due to circumstances back in their countries. They applied for expeditious approvals. I dont think any cases from pakistan got expedited. Just see the timelines you will find out the time period of approval in different cases from Pakistan.

Okay now yesterday i got a mail stating that they require RFE in order to process my case. I wanted to know is that a red flag that my petition wont be approve. And even if i provide more evidence to them how much more time will they take in processing my petition. Do I have to pay more fees as well due to RFE. And in how much time should i respond to that RFE? I would be glad if some one could help me out in this. Thanks

Answers:

  • You won't know what the RFE is for until you receive the mailer stating what it's for. All you have in-hand now is the notice.
  • Being issued an RFE is not in of itself a red flag to ultimate petition approval.
  • You only need to provide what is being asked for, nothing else.
  • Once they have your response back, it will take as long as it takes. I couldn't give you an estimate.
  • No, you don't have to pay any fees due to having been sent an RFE.
  • The deadline to respond to the RFE will be clearly stated on the notice.
