Hello All,

Please can you help with a simple question?

I notice that our co-sponsor needs to prove they are a US citizen, with a birth certificate or a copy of their passport.

However, I've noticed that when we book our marriage ceremony my babe needs a new-style full birth certificate that shows both of her parents names on it.

Is that the same for the co-sponsor of the i-134 - will they have to provide a new-style long birth certificate as supporting proof?

Very grateful for any help on this - anyone with experience - as I can't find advice anywhere!

I thought is was pretty standard for American birth certificates to have parent names on them. What state gave your wife a short version? Only curious.

And for an I-134 at London, I am not even sure they require that proof. It is not in the instructions, nor the law. I can't remember anyone having an issue over a sponsor's birth certificate at a London interview with an I-134. They are pretty flexible there and also don't require all the financial proof VJ tells you to bring. Example--they do not require a tax return if you have proof like an employer letter.

You will need the proof of the joint sponsor's birth for the I-864 with adjustment of status, so might as well get it lined up. Have you asked them if their parent is listed on it?

Sorry for the rambling that doesn't exactly answer your question but I don't think London cares or needs to see it.

it's NJ - but a lot of states years ago used to give out a short version, here's the link to the requirement for the new style birth certificate to be valid as proof of USA citizenship http://travel.state.gov/content/passports/english/news/new-u-s--passport-requirement0.html which came in April 2011

So, when on the i-134 it states the need to provide US citizenship for the co-sponsor to be valid. so I hear everything you say about the possibility of not needing it, but like many people here, I'm not prepared to take un-necessary risks after 6 months of waiting for my K1...

I totally understand your thinking. (I can't seem to find in the I-134 where it says proof is required. )

And the Foreign Affairs Manual 9 FAM 40.41 N5.6-3 procedural Notes (2013) doesn't state it. It does say non US citizens are not the best choice to trust as the sponsor. But that indicates there is no statue against it.

NOTE: When there are compelling or forceful ties between the applicant and the sponsor, such as a close family relationship or friendship of long standing, you may favorably consider the affidavit. On the other hand, an affidavit submitted by a casual friend or distant relative who has little or no personal knowledge of the applicant has more limited value. If the sponsor is not a U.S. citizen or lawful permanent resident (LPR), the likelihood of the sponsor's support of an immigrant visa (IV) applicant until the applicant can become self- supporting is a particularly important consideration.

But if the Dept of State says parent names on a birth certificate are needed to prove citizenship and you plan to take proof, then I think parent names it shall be because the embassy is under the DOS.

No problem. It's been bookmarked for a long time. And I have been helping London interviewers in the UK FORUM since 2008, so know London seems to be quite easy with the I-134, often never even discussing it if they glance at the papers and it looks reasonable. People have been approved with:

-One proof of income. Given a choice they seem to pick the employer letter as their fav and often hand back the rest.

-100% of the poverty guideline

-No I-134 from the fiancé, but only the other sponsor with the income

-Immigrant sponsoring himself on assets by showing proof. No I-134 at all in that case.

-And even a last minute scanned copy of the I-134. (Pretty blonde who was good at begging)

You never know what will happen on your day, but in general you can relax a bit knowing they are not hard nosed people trying to fail you.

When you file for AOS, all the strict rules are written into INS law and apply to the I-864 Affidavit of Support to be filed.
