Most persons on this forum are going through completely legal procedures to AOS.

There are a lot of hassles in doing such, and more than a few have come under magnifying glass scrutiny regarding question of do they have a valid marriage etc.

Soon, unless the decree is overturned, the administrative people involved will be overloaded with processing people who arrived in USA completely illegally.

In view of processing illegals, what are the thoughts about how they will continue to process and treat those who came legally and are going through the process in a completely legal manner.

Will authorities continue to micro investigate us, given they are charged with making legal those who came illegally?

10 YEAR GREEN CARD PROCESS

July 22, 2017  ROC packet sent to Vermont.

July 24, 2017  ROC packet signed for in Vermont.

August 8, 2017  NOA received at house.  15 days since ROC signed for in VSC.

August 12, 2017 ASC appointment received. 19 days since ROC in VSC.

August 25, 2017 BIO completed. 32 days since ROC received in VSC.

August 11, 2018  18 month 'Courtesy Copy' extension letter received.  Critical number  297

October 20, 2018 18 month 'Official' extension letter received.  Critical number 297

December 4, 2018  USCIS Account shows: We approved your Form I-751, Petition to Remove Conditions on Residence, 

December 4, 2018, ordered your new card for Receipt # EAC17297003XX, and will mail to the address you gave.

491 days from NOA issued by VSC until Petition approved.

December 7, 2018 USCIS sent notice:  Card mailed.

December 12, 2018 Ten year Green Card received from Lees Summit, MO

499 days from NOA issued by VSC until Green Card received.

CITIZENSHIP PROCESS

December 6, 2018 submitted N-400 application on-line.  Estimated Completion Time: 8 months or August 2019.

December 8, 2018 received notice on USCIS that Biometrics scheduled . . . but the actual date was not yet shown.

December 11, 2018 saw in 'Documents' section of USCIS that Bio scheduled for 24 December 2018.

December 21, 2018 saw on USCIS website that they will be closed 24 December 2018 as extra holiday.

January 9, 2019 went for re-scheduled BIO appointment.  33 days after N-400 submitted on-line.

February 19, 2019 received letter in US mail that Citizenship interview scheduled for 26 March 2019. 74 days after submission on-line.

March 26, 2019 Citizenship interview scheduled for.  109 days after N-400 submitted on-line.

March 26, 2019 Passed Citizenship interview.

April 12, 2019  Received notice that Oath Ceremony had been scheduled for 24 April 2019.  17 days after interview.

April 24, 2019  Oath Ceremony completed.  29 days after interview.     139 days after N-400 submitted on-line.

April 25, 2019  USA Passport Application submitted.

May 3, 2019     USA Passport received.    149 days after N-400 submitted on-line.

May 9, 2019     Certificate of Naturalization and Citizenship returned in mail.

at least I hope not, they won't be going through adjustment of status or consular processing, it's only a work permit for those who qualify, DAPA is a work permit and they have certain requirements to qualify, not all will qualify

About half will qualify, 5 million or so.

And the correct term is Prospective Citizens, not illegals.

I would expect delays but not changes in procedures.

AFIK they don't get a green card and there is no process to citizenship unless they marry a USC. They get a work permit, SSC, drivers licence etc. I doubt that this will have any impact on those adjusting after entering legally, with the exception of possible delays. Anything suggesting otherwise is generally racist scaremongering from the anti foreigner brigade. At least that's what my lawyer said when I asked the exact same question.

Possible delays? Delays have happened before and will no doubt again.

There are other routes to adjust than marriage.

The crux of the question is that no one can actually measure impacts or delays, because the system is not based on a line. Many wish to believe it works FIFO but it doesn't. Different cases are adjudicated in different centers and the workload varies.

One of the major misconceptions about immigration is that the system works like a cookie cutter and that every case is the same. But then again, there are those who thrive on fear and misery and they are not likely to change. Even within similar cases, the order is not linear.

AFIK they don't get a green card and there is no process to citizenship unless they marry a USC. They get a work permit, SSC, drivers licence etc. I doubt that this will have any impact on those adjusting after entering legally, with the exception of possible delays. Anything suggesting otherwise is generally racist scaremongering from the anti foreigner brigade. At least that's what my lawyer said when I asked the exact same question.

@Boiler - I think you might have completely misinterpreted what I said.

The OP was referring to the recent immigration reforms, announced by the president and their impact on illegal immigrants. These reforms aren't really that much apart from not deporting them for 3 years and giving them the ability to work legally, providing they meet certain criteria. It is not a path to citizenship or permanent legal residence. It is not a green card, it is not citizenship. It's not any of the things that the redneck brigade have claimed.

Sure there are other routes for illegal immigrants to adjust status, but they aren't exactly easy or likely, and its hardly going to open the floodgates. It's processed by different areas than those who are adjusting, and I very much doubt that those who are here illegally will be given preference to those who have gone through the legal processes. There will likely be delays, but it's hardly something I'd be worried about and my case is being processed currently.

Regardless, anything that gives these people (many of whom are fleeing from some pretty nasty stuff in central and south america) some level of legal protection and the ability to participate in society is a good thing.

Ohh dear.

There are c5m beneficiaries, I have heard that USCIS is recruiting but no way will it just be new staff processing extended DACA/DAPA.

It is not just work permit, includes AP.

I do not know the number with children who can sponsor them, but just to use these as an example, the children can not file waivers but the Parents can now travel on AP, come back in and adjust.

According to the OP's timeline, there is an AOS from a student visa... One could easily argue misrepresentation and the OP is offended because of the "illegals"?

A country of Immigrants, that hates new Immigrants... Maybe if education was a right and NOT a luxury, it would be different.

This is U.S. Immigration 101. Undocumented or not, we are all immigrants, right?

On a different note, I don't recall the exact percentage of participation after the last executive order, but it was nowhere near 100. In other words, even if 5 million people were eligible, there won't be 5 million extra petitions in the USCIS system. Moreover, it requires resources. Anyone applying for DACA will have to find and pay for a lawyer, pay for fees, get documentation sent from their birth country, etc. As many as of us know, this process takes time. Again, if Congress approves a budget that funds USCIS, there will NOT immediately be 5 million applications flooding the system.

So honestly, I wouldn't even even expect major delays in the processes of the "legals". But I do think it's important to keep an eye on the legislative process trying to block the president's initiative.

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

There's no plan in place, even less a law, to give any illegal alien permanent residency. If, and I must emphasize this, if the GOP-controlled Congress really feels that giving a little will gain them votes in November of 2016, you can expect the President to sign such a bill into law at the end of 2016. The first illegal aliens will then get a work permit early in 2017 and would be eligible for AoS around 2027. Maybe you guys should chill a bit . . .
