Hi I just wanted see if anybody had got a approve ap with a pc 243 e 1 domestic battery (which was just snatching a phone away) and return safely, my attorney said I should be fine, but I'm kinda worried of them rejecting my return home..

Are you looking to adjust after using AP?

I have yet to come across someone with DACA AP not being let in.

So the DACA came before the conviction.

I was wondering how you obtained DACA with a DV conviction.

I would consult a few other lawyers, doubt if any will give you a guarantee.

I had the conviction after daca, after having a few days at jail was release to ice where I was later release for having daca. It's domestic battery not domestic violence and you can still get daca with pc 243 but its 50\50 chance you will get approve.

I would be interested to know the reasoning for the Lawyers views.

I am no expert but a single non serious misdemeanour gets you DACA, I am assuming that the issue with AP is whether the conviction is a CIMT, and that the admission qualification and the AP qualification are not a direct match.

DV, I was thinking of another thread some time back where somebody wanted to go the DACA route, DV is I understand a serious misdemeanour.
