I agree with TeddyB, totally, do what "works for you".,., does anyone think that what is going on at TSC and NVC is fair?

The moral of the story is don't bother petitioning for a K1 visa or CR-1 if you are under ESTA or have a tourist visa. Just travel to the US with no intention of getting married, change your mind (or have the petitioner be oblivious to the law) and then AOS.

(Of course I am not advocating this, just stating the unfairness and the typical abuse of this loophole).

My feelings exactly! To believe they had no intention of getting married before she entered th US is a complete joke.

Why they allow this loophole to exist makes no sense.

Might as well have the law state ESTA eligible countries are exempt from K1 requirements.

You can't put everybody in the same pot, because I came here with ESTA doesn't mean everybody with ESTA is in same position. As I explained before what happened at the aiport is what made things change. We had no hurry to get married because my husband spends months of the year outside the U.S. because his job, and we wanted a nice weeding. So there was no need for me to stay here if he is not here, I would come visit a few months and when he was gone I would travel with him or go back to spain and this situation was working for us but after told not allowed in the country anymore he didn't want to deal with that since he can't just quit his job and come to Spain to visit me and then what.

I have no need to lie, my husband wrote an affidavit letter explaining the whole situation when we sent our forms. There can be reasons why our interview was so calm every couple and circumstances are different. I had to spend months here alone in a house not being able to drive, waiting for some family member to come the weekend to help me buy groceries because my husband had to go. It was not the situation we had planned, I still have a friend in Spain taking care of my pets because I was supposed to go back. Don't judge people so fast saying its a joke/lie.

I'm not saying by any means to people to do it this way and saying its easier. It's not.

Congrats, you waited 6 years WOW. A k-1 would have easy a long time ago then plan a wedding after that???

Haha thanks, yes I know :) I guess that could have been a choice but since my husband travels so much for his job, he spends many months out the country so there was no hurry for me to live here.

we were waiting until the situation was more stable and on the meantime started saving money for a weeding. We spent lots of times together every year anyways.

I was only 19 years old when we meet and started dating ( my husband is 8 years older than me ) and I almost didn't speak English, then I was in school... so even I knew I would marry him one day there was so much to do before that moment.

I understand for lots of people from other countries it's so hard to come visit the states that they need to get married faster to be able to stay together.
