No way of knowing without seeing the letter that will come explaining the refusal. At a guess:

- someone pressed the wrong button and it is ot actually refused

- Something showed in the medical that made them refuse the visa- maybe drugs?

As someone who used to work for DoS, you have a case of the "soft" refusals. This denial is not permanent. The Consul had to refuse as he/she didn't have the required information in order to approve. Once the medical comes in -- which I assume it has by now -- your fiancée can arrange for another interview date and the next Consul will see in the system that it's a 221(g) refusal which thus allows him/her to approve the visa provided the medical comes back fine and nothing else is considered a roadblock. Any refusal should come with a formal letter detailing the legal reason for denial. From what I understand, a late document is not really grounds for denial, as that can be handled through an RFE. I wonder if the medical result had something in it that caused concern for the embassy. Regardless, the embassy should send you a letter specifying reason. Have you received such yet? If it is only the matter of a medical report submission, you should be able to provide that then interview again, once that new information is processed by the embassy. An entirely new petition should not be needed it it is only a matter of a late document, as that is dealt with on the embassy level.

I am sooo sorry this is happening to you. I read your other post about shady doctor. Don't panic yet. I read a very similiar post and spoke to a lady whose fiance's medical was delayed (in Jamaica) and system showed refused, but it was changed later. I really hope this is temporary. I would e-mail embassy (yeah, I know that they are so busy and don't reply in most cases, but try) and ask about it. Go step by step with your fiance and over all questions doctor asked and at the interview. Any possible health issues? Or did he told doctor maybe he smoked marijuana before? People get refused for that or TB, etc..that doctor was ready shady, so I would try to get bottom of that. E-mail or call her as well. How did interview go? Was he told he was approved, but need to go through mandatory AP?

Our medical was late in Sweden and we were given a 221(g), basically a refusal, until the medical came in.

Ohh I just read one of your replies that he was refused only for medical. Don't worry, once they receive medical it will be OK! I can't find the exact same post from somebody in Jamaica and it was showing refused in the system and after they received medical he received his visa. Don't worry, things will work out for you guys!

I hope so. This has been a huge blow to his manhood, especially after the interview went so well. Hopefully we won't have to start over but are prepared to start the entire process over again, worse case scenario. When I contacted the embassy, they said

Thank you for your inquiry. We can confirm that your fiance’s petition was denied, but for privacy reasons we cannot disclose any further information to anyone other than the applicant.

He hasn't had any success contacting them either. They haven't responded to his email nor his phone calls. He's going to go to see if somehow he can schedule another appointment, perhaps complete the medical with another doctor and turn in the results himself.

if the interview went well.. and its for sure a denial the only thing im thinking is what was in his medical? even if you start the process over again if its something in his medical wouldn't it be a problem again? just wondering

Let's not freak out the OP with medical worries.

Maybe I am being too western in my thinking, but if the panel physician finds something wrong with you during my visa medical they damn well better tell you. Anything else is unethical and a severe violation of patient rights.

Since we have not heard that from the beneficiary, I'd not assume this to be true. The list of medical inadmissabilities is pretty short anyway - and those are the ones a patient needs to be told about immediately anyway in the rare case they might pop up during a routine visa medical and the patient is not yet aware of his condition!

I see you already contacted Embassy. You are the applicant. Why they are saying they can not disclose any information other then the applicant? Contact them back and tell them you are the applicant. Looks like some stupid ignorant people working at this embassy.
