We're in the same boat. We just found out we were denied and now we're crushed. Really not looking forward to starting this process over again. . . :cry::cry::cry:

An engagement ceremony is an Indian custom. That's the only reason why it would be a red flag to not have one. A CO in India would be aware of cultural norms and take that into consideration. I don't believe that's a custom of the Philippines. There's so many variations between embassies!

If they hold my fiancé and me to Singh's standard we'll be in bad shape. We never even had an "engagement party." In fact, we're not even planning a big wedding (been there; done that; blown that money; marriage didn't work anyway).

Big parties, ceremonies, and weddings are fine if you want them, but they've nothing to do with the actual marriage itself. In fact I've heard the bigger the wedding, the greater the chance of divorce (I've no idea the veracity of that).

Meeting only once only to become engaged is the red flag. Look at it through the eyes of the CO, you had never met, you get engaged during your one and only visit to meet her then you petition her. I know that it is only a requirement that you only have had to meet within the 2 years prior to sending the petition but India is a very high fraud country and they are basically sayng the don;t believe your relationship is real. you say you sent 300-400 pages of supporting evidence, that is too much. Many people who have been denied say they were told by the CO they actually sent too much evidence, it looked as though they were over compensating because of lack of a true relationship. I have seen that several times here on VJ. Did they say they were denying the visa and sending it back for revocation or did they say she was in AP? before running off to marry her you need to clarify that withe the consulate

I met my fiance in person on 5 different trips and we brought a lottt of evidence to the interview. Is this really bad? Isn't it better to have more than less? Better to be safe than sorry? I read that some people were turned down by not having enough and needed to send more. All our eveidence was kept by CO, even very personal cards I received in the mail; which, meant a lot to me. Should I and other worry we had too much?

Did I read your post correctly, when you said you only visited her once? I thought for a K1 visa you definitley need to visit at least twice.

The minimum requirement is once in 2 years, but ofcourse is better more. I read some people were approved after meeting only once.

I did not take a copy of my I-129-f document and all the other document that I sent to USCIS. but I have a soft copy on my hard drive. will I still be able to print this out sign and send it to NVC when i receive my NOA2. or they will need the actual copy of the document I sent to USCIS.???? thanks for your help

Was denied on the same ground in Jan. 2014 at Delhi Embassy. CO herself advised me to get married and come back again. We got married and now at the tail end of the process at NVC. I have visited thrice after marriage and I am planning to go again for the Interview.

Good to know, thank you. Its just v frustrating to start all over again.

I'm pretty sure USCIS send all the documents they have to NVC. The copies you have are good incase USCIS needs more evidence or if the beneficiary wants to go visit the states it's good if he/she brings them just to be on the safe side.

The reason for the 300-400 pages of evidence is because we love each other and speak multiple times in a day. Why wouldn't we bring all that evidence? And yes looking back, going back once only to see is a mistake, but it doesn't say anywhere multiple trips are needed. We communicate every day.

Even now going forward, when I do apply for spousal visa, I will make multiple trips, but they will be for a week to 10 days. I hope these people at the embassy understand it is difficult to take a lot of time in US due to work. (They have no common sense it seems)

The case was sent back to USCIS for further inquiry, who knows how long they'll take. On the phone, someone told me could take 180 days, ridiculous!!

Did you send those 300-400 pages with the initial application or was that what she brought with her? If they say there wan't enough evidence and weren't interested or willing to look at what she brought then it sounds like maybe what was sent in the beginning was not adequate?

My fiance brought all that evidence with her to the interview. They had her there for 3 hours.

Another question counselor asked: Why did you apply so quick, what's the hurry? (From the point, I met my fiance till the interview date, it had been 17 months), how is that a rush.?!?! Rather I think it took too long for a fiance case.

You do not have to wait for USCIS to respond, your petition will expire in 6 months. You can go and get married as soon as you wish.

Get more visits in and make sure you have lots of photos from the wedding with family and guests. We were refused too and re filed a K1 and

then were approved. I know the feeling of frustration but hang in there !

After your first refusal of K1, you re-filed for K-1 again, and not spousal visa? They were ok with that?

Good for you it worked out, but I'm nervous applying for K1 again, probably opting to marry her apply for spousal visa.

Well, this is a "bum wrap" for you and your loved one, it is heart breaking. I can read the love in your remarks.

I would marry your loved one, (I am a huge fan of the K-1 visa) if the K-1 fails, hang in there, do the I-130, and show them at the consulate, "yes I intended all along to marry my loved one" use that thought to make you strong, to over come this.

Yes, we are very hurt. First, we were sad, cried, then came anger, and now slowly we are coming back to reality. I will apply for 130 shortly, planning to go to India next week.

I am just wondering if the outcome would have been different if you showed up to the interview?

Yes we all have to work, but we also have certain priorities in life that take a higher priority.

I am more inclined to believe any manager/boss/supervisor with prior knowledge of your pending event and advance notice that you WILL need a few days to a week off to tend to this matter, would deny your request.

I see, nit. Yet you had the engagement ceremony anyway, but they still denied you..wow.

Re the 300 pages contact evidence, we're not going to submit more than a sample page or two. I'm not having my sweetie lug around that much paper to the embassy on the big day. We chat everyday. If they believe her, they probably won't even look at the samples we bring. If they don't believe her, they probably won't even look at the samples we bring. Just my take on all this. Not scientific opinion here...

yep. as is always the case with visas, especially tourist visas, whenever the CO is leaning towards a denial they actually ask for things. They already make up their mind before even talking to you.
