I looked at the K-3 guide on this website and it looks cut and dry, but I looked online on the travel.state.gov website (http://travel.state.gov/visa/immigrants/types/types_2993.html#Two) and it mentions forms DS-156 and 156K, which are nonimmigrant visa applications. These forms arent mentioned in the K3 guide on this website. What are those forms? Does my wife bring these with her to the interview at the end or do I have to send them off with my I-129 or I-130? How exactly does this work? The I-129 isn't the the application for her visa? If anyone knows, please help me out. Thanks in advance.

The I-129 and I-130 are visa petition forms. Once approved in the US, they are sent to the foreign consulate for the interview. The foreign consulate has their own requirements of documentation for the interview. Check their website for specifics of what they will send to you and your fiance and what they require before an interview can be scheduled.

Applying for a Visa

The embassy or consulate where you, the spouse of an American citizen, will apply for a K-3 visa must be in the country where your marriage took place. Here are the procedures to apply. The embassy or consulate will let you know any additional things to do, such as where you need to go for the required medical examination. The following is required:

Two copies of form DS-156, Nonimmigrant Visa Application

One DS-156K, Nonimmigrant Fiancé(e) Visa Application form

Police certificates from all places lived in since the age of 16

Birth certificates

Marriage certificate for spouse

Death and divorce certificates from any previous spouses

Medical examination (except vaccinations)

A passport valid for travel to the United States and with a validity date at least six months beyond the applicant's intended period of stay in the United States .

Two nonimmigrant visa photos, two inches/50 X 50 mm square, showing full face, against a light background)

Proof of financial support (Form I-134 Affidavit of Support may be requested.)

Payment of fees, as explained below

The consular officer may ask for additional information. It is a good idea to bring marriage photographs and other proof that the marriage is genuine.

Documents in foreign languages should be translated. Take clear, legible photocopies of civil documents, such as birth and marriage certificates, to the visa interview. Original documents can then be returned to you.

Ok, so she has to bring these forms with her to the interview. What about the DS230? That has to be brought to the interview as well? Thanks.

Every consulate is different. Some send a list of documents that need to be sent back before the interview can be scheduled. Some have the beneficiary bring them to the interview. Most require the DS-230 but not all and when you provide it depends on their rules.

You need to research what your consulate requires:

Fiancé(e) Visas

K1 Visa Processing in Guangzhou

The U.S. Consulate General in Guangzhou will notify the applicant when the approved petition is received and mail the applicant an instruction packet including biographical data forms (DS-230 and OF-169). This packet also includes a list of specified branches of the CITIC Industrial Bank where applicants can pay for the RMB830.00 processing fee prior to the interview. A fiance(e) visa applicant is an intending immigrant and, therefore, must meet documentary requirements similar to the requirements of an immigrant visa applicant.

After we finish initial background clearances for the case, we mail the applicant an appointment packet of interview-related information. This packet includes an invitation to the interview, required medical forms and contact data for specific hospitals approved to conduct medical checks.

The U.S. Consulate in Guangzhou handles thousands of cases every month. Hence, you can expect one month between the time we receive the applicant's DS-230 part one and OF-169 forms and the time an interview is scheduled.

During the interview, it is the applicant's responsibility to provide information to show a bona-fide relationship with the petitioner. The adjudicating officer uses the interview as well as the information brought by the applicant to make a decision.

If the visa is denied, the applicant will have an opportunity to provide further evidence of the relationship.

If the visa is approved, the applicant will be required to make delivery arrangements with the designated China Post Office located in our office to either have it delivered by submitting a notice and the interview appointment letter or to pickup the visa two business days later at the Jun Yuan Post Office of China Post. The visa will be normally valid for half a year.

If you have further questions, contact the Guangzhou Immigrant Visa Unit at http://www.usembassy-china.org.cn/guangzhou/iv/email.html.

Thanks for your replies. I suppose I would use the DS156 and 156K because we are going for a K-3 visa. I appreciate it.

I didn't realize you were going for a K3.

Read the K3 instructions on their site and hopefully you will find out exactly what forms they use. If not, they will definitely send you the packet with instructions or someone in the regional forum will be able to tell you what is necessary
