Okay this might be a crazy question but if you could give me laws that says in anyway that if you help an alien stay illegally you could face legal consequences. My intention is to write a letter as NickD did where I bound myself legally to not to help my brother in any way to overstay or stay here illegally. I know they are looking at him and they need explanation from him, but I think if I did that I show that we (here in USA) dont have no intention of keeping him here it would help a little.

( I was going to notarize the paper too to make official)

Any thoughts?

Honestly, I don't think that will help at all. Any mention of him overstaying will only weaken his case. He needs to convince the interviewer that he has ties to his home country that will necessitate his return after a brief visit. That's all that matters.

Technically if he wanted to break the law, he can do that without your help, so your letter would not be relevant.

He needs to apply and hope for the best. People get approved all the time... hopefully it won't be a problem, but he has some points going against him.

Good luck.

This makes it seems desperate.

You can't legally bound yourself because the US does not accept these types of letters.

Furthermore, notarizing a letter means that a notary saw you sign it. It doesn't make whatever you write more valid than something not notarized. A notarized letter doesn't mean anything.
