Hello. I am the U.S citizen who has petitioned for my fiance from Poland to move to the U.S with the k1 visa. Our visa has been accepted and we are preparing to make the move to the U.S


My question is about the I-864 when applying for adjustment of status. I currently only have a part time job because I will be also studying soon. When we first arrive in the U.S we will be staying with my mom for just a couple of months until my fiance has permission to work. Than we will be moving out on our own. My mother has agreed to be a sponsor for my fiance and she exceeds the poverty guidelines. From what I understand since I am the petitioner I have to fill out the I-864 even if I don't meet the requirements. My question is does my mom fill out the I-864A since we will be living in the same house or can she just be considered a joint sponsor since we won't be staying there very long and fill out her own I-864.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Does she claim you as a dependent on her taxes? If no, then have her file an I-864 as a joint sponsor, then she will need to meet the requirement for her own household size plus the immigrant, and you will not be included in her household count.

If yes, then have her fill out an I-864A as a household member instead. You will all be included in the household count, but your incomes will be combined to meet the requirement instead of needing to meet the requirement individually.

If she will be your joint sponsor, then she will not be included on your I-864.

How to count household size >

Your household size includes yourself and the following individuals, no matter where they live: any spouse, any dependent children under the age of 21, any other dependents listed on your most recent Federal income tax return, all persons being sponsored in this affidavit of support, and any immigrants previously sponsored with a Form I-864 or Form I-864 EZ
