ok so i entered the US under the VWP i have been here before to visit my boyfriend on it this is my second time and this time we decided we didn't want to be parted again so we decided to get married but due to his work scheduled we have the marriage licence but cannot get married untill 4 days after my visa expires as he has no days off and his boss will not let him have any except his regular Monday im wondering what would happen and if it would be find if we got married after my VWP expires and file the aos forms and required forms with them all really worried im going to get denied because of it or deported anyone please help panicking female

Went And Got Marriage licence Jan 14th

entered US legally under VWP oct 25th VWP about to expire on Jan 22nd

thanks everyone i was just so worried because we would be getting married and filing after my VWP expires was worried i would be deported in between or they wouldn't accept it

sorry im new to this so had no idea just wanted quick answers before i lost my mind also another question the petition for alien relative do you send it with the I-485 or do u send it alone a thew days before ?

You can do it both ways. I think most people send it together. The only reason I see not to do it is if you are short in cash and like to get one out of the way already.

There is probably other reasons too, but I don't know of any.

I sent mine together this January (7th), so far so good, as everything got accepted. :)

By the way, I overstayed my visa for very long, and like others said, is not a problem.

i have all the cash to send them all right now thankfully i was just wondering how that worked looked at alot of guides but it just really says where to send it and how to put it together like aka what forms you need and stuff anyways thanks alot guys really put me at ease getting MARRIED IN 4 DAYS :D he talked to his boss and got the monday off so we will be getting married 2 days before my visa expires but think it will still be a day late as i haven't had my medical yet

so was curious also as u can tell this is all rushed and had no idea it would happen but he wants me to take his last name im not a us citizen gonna do aos soon but would i go about having his last name how does it work ?

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

I don't know of the process, my wife is the one who wants to take my name. You can change your name later, and we agreed to do so, as it would require more paperwork to be submit, plus kept with you to prove who you are.

I wanted to have everything as simple as possible since we are not using the help of an attorney.

I would strongly advise against a foreign person taking the name of any husband in another country.

Your passport and many other documents are in your original name.

Getting all of that changed will be a nightmare. You will be forever having to prove that you and your previous last name are one and the same person.

And, if you own land or other assets back in your home country, you will have even more nightmares if you get your passport changed to the name of a man living in another country.

Sure, I realize that most women do take last name of their husband when both born and raised in same country. No too much problems.

But with a foreign citizenship and other complications, it can be much more troublesome down the road.

July 22, 2017  ROC packet sent to Vermont.

July 24, 2017  ROC packet signed for in Vermont.

August 8, 2017  NOA received at house.  15 days since ROC signed for in VSC.

August 12, 2017 ASC appointment received. 19 days since ROC in VSC.

August 25, 2017 BIO completed. 32 days since ROC received in VSC.

August 11, 2018  18 month 'Courtesy Copy' extension letter received.  Critical number  297

October 20, 2018 18 month 'Official' extension letter received.  Critical number 297

December 4, 2018  USCIS Account shows: We approved your Form I-751, Petition to Remove Conditions on Residence, 

December 4, 2018, ordered your new card for Receipt # EAC17297003XX, and will mail to the address you gave.

491 days from NOA issued by VSC until Petition approved.

December 7, 2018 USCIS sent notice:  Card mailed.

December 12, 2018 Ten year Green Card received from Lees Summit, MO

499 days from NOA issued by VSC until Green Card received.

CITIZENSHIP PROCESS

December 6, 2018 submitted N-400 application on-line.  Estimated Completion Time: 8 months or August 2019.

December 8, 2018 received notice on USCIS that Biometrics scheduled . . . but the actual date was not yet shown.

December 11, 2018 saw in 'Documents' section of USCIS that Bio scheduled for 24 December 2018.

December 21, 2018 saw on USCIS website that they will be closed 24 December 2018 as extra holiday.

January 9, 2019 went for re-scheduled BIO appointment.  33 days after N-400 submitted on-line.

February 19, 2019 received letter in US mail that Citizenship interview scheduled for 26 March 2019. 74 days after submission on-line.

March 26, 2019 Citizenship interview scheduled for.  109 days after N-400 submitted on-line.

March 26, 2019 Passed Citizenship interview.

April 12, 2019  Received notice that Oath Ceremony had been scheduled for 24 April 2019.  17 days after interview.

April 24, 2019  Oath Ceremony completed.  29 days after interview.     139 days after N-400 submitted on-line.

April 25, 2019  USA Passport Application submitted.

May 3, 2019     USA Passport received.    149 days after N-400 submitted on-line.

May 9, 2019     Certificate of Naturalization and Citizenship returned in mail.
