How to get TX DL or ID as Adjusting K-1

I think you might be confused on some of this.

I'm not sure why you expected the evidence of residency requirements to be different for the state ID to the state driving license. It's the state ID aspect of the driving license that requires proof of residency. EDIT: Just noticed that the link you were given above about the Texas ID card even specifies that you have to provide proof of state residency and gives you a link to the list of documents you can use for proof.

I'm even more unsure why you would want her to renew her state ID and get a driving license. The state ID is just there for people who need ID but do not drive. Once you have a driving license, the separate state ID is redundant. I doubt you're even allowed to hold both. On top of that, your wife should be able to use her passport for ID for most requirements, though that can't be used to prove state residency.

I carry both. I like the redundancy for multiple personal reasons. Not a big deal though. It's simply a mistake I made in not realizing that they would strap the end date onto the end of the TX ID to match that of the I-94.

Sounds about right, I did the same process couple of weeks ago, I just got my wife Texas ID, but I asked about the DL and it would expire when her 90 days K1 entry date expired, same on TX ID.

I pretty sure you can had both DL and ID. I got mine a TX ID so she does not have to carry passport everywhere, and she was able to get Texas Fishing License.

I will wait to get her EAD before she returns to get learner permit/driver license......

That's exactly our plan. She is weary of carrying her passport. We'll renew the ID when she gets EAD. We will also use EAD to get her DL.

It's perfectly legal to hold both a TX ID card and a TX driver's licence at the same time.

An update is in order. Apr 10, we went to TX DPS to get my wife's TX ID & DL, since she had EAD/AP Combo Card since Mar 27. Even though she had her EAD/AP Combo Card in hand, DHS apparently didn't update her status internally, so when TX DPS tried to verify, it didn't show her EAD. So they pinged DHS to update. TX DPS told us we would get a letter in the mail from them & then we should return to TX DPS to get my wife's TX ID & DL. The letter was received on Apr 23, so my wife went back to get her TX ID & DL. They told her that apparently the request was only sent for her ID & not DL, so they were only able to approve her ID & submitted the same request that they sent 2 weeks prior, but this time for her DL.

So another wait on another letter. She received this one 2 days ago & subsequently returned to TX DPS yesterday to get her TX DL. She decided to use the reciprocity agreement for the license exchange. Apparently it's a fairly new requirement that TX DPS acquire an English license. Luckily, my wife got her International Driver's License before she left Germany. TX DPS took both her German License & her International License. They told her had she not've had the International License, she would've had to have paid for an English translation of her German License or have the German Consulate in Houston do it. Luckily, she had everything needed to get her TX DL yesterday.

TLDR: My wife now finally has her TX ID & DL processed to expire 1 year after the EAD was issued, basically the same time the EAD expires.

Thanks. And I'm happy for your wife; Texas is a good place to learn to drive, unless you're in Houston. Lucky for her, she didn't learn in China. Driving there is plain nuts.

Hi everyone living in Texas, I want to let you guys know that you can apply and get your drivers license even if your K1 visa (i94) validity is expired as long as you have applied for adjustment of status.

 

My hubby had applied for drivers license with his K1 visa and was given a driver's license that expired same day his visa expired. Then he applied for renewal using the NOA1 he got after submitting the AOS documents. The office then sent the NOA1 document to DHS for second verification which took a week. Verification came out positive as the DHS confirmed he has a pending AOS application and therefore has legal presence in the US. He got a letter in the mail confirming this. He then had to go back to DPS with the letter and complete his driver's license registration.

 

I am told certain DPS officials don't accept the NOA1 and will tell you to come with either EAD or greencard before they can attend to you. My advice is that you stand your ground and insist that you meet the requirements for Driver's license since you have a pending AOS application. Request that they do a second verification. Request for the supervisor if they are stubborn. You can as well try another DPS location if the supervisor is also ignorant. My hubby got his in Mckinney DPS office. There are two documents that you can use to make your argument. One is the DPS Verifying Lawful Presence Guide and the second is the Real ID Act document (they are both pdf documents and can be foind online).

 

I had to post this as there are conflicting info on whether one can get his or her drivers license with the NOA1.
