Hopefully he is thinking about the child. I've read none of his other posts.

If I was getting a divorce from a woman who had cheated on me with multiple guys I would want full custody. That is best for the child; a mom who is doing this is not demonstrating any kind of good moral character at all (I bet she didn't volunteer her history of infidelity at her meeting, either) and if the father is otherwise a decent person I'd rather see the kid go to him.

What could in theory happen is she is deported and loses access, similar to this case:

http://latino.foxnews.com/latino/politics/2012/03/12/north-carolina-child-welfare-officials-want-deported-father-stripped-parental/

As mentioned above if she already took her oath it's much harder to remove citizenship, but some stat I read earlier today said around 10-15% of applications for naturalization are denied, so it's definitely quite common.

IF this person has cheated multiple times on her husband and IF she has lied about still being married, despite marriage being the necessity of her application, it would definitely not bode well for her approval.

That might be true. It's too bad they didn't get the divorce done already. On this guy's behalf I hope a multiple-cheating wife doesn't get full custody of his child.

I think this is an impossible situation and the OP should just move on and focus on the divorce and his child. That's what matters here.

A country of Immigrants, that hates new Immigrants... Maybe if education was a right and NOT a luxury, it would be different.

This was her final interview. All that remains is swearing in. I've been reading as much as possible and my latest concern is that it appears custody is a separate issue from citizenship. I'm not so sure they wouldn't issue an order whereby the child spends three years and one country and three years in another country, back-and-forth until the child is old enough to decide. If this is the case then I would not be inclined to report her.

Yes 90K per year and that's entry-level state employee in California. By the way, all the men she's met online have incomes listed in the $250,000 to 500,000 range on their profile.

I have no problem with him seeking full custody through the courts, that is his right. It's this extra curricular stuff with USCIS and his wife's immigrant status that I am referring to. This line below is what I'm talking about. It seems he is hell bent on having the mother either deported or charged criminally, in no way do either of those options benefit his child.

My question is if I report this and she gets deported what happens to my son? Would he stay in the US with me? Is there a chance that she would still be able to stay here?

If she's been cheating on you all along do you even know for sure that the child is yours? Just putting it out there,

also in your previous topic you said the interview on Jan 9 was for removing conditions...your topic here says naturalization interview. Naturalization is citizenship, not removing conditions. Two totally different things. Was her interview for removing conditions or citizenship?

this is a quote from your last topic

"Should I also pursue fraud charges on the marriage? She has her green card and we've filed paperwork on the lifting of restrictions (i-751). Her next interview is Jan 9. I want as much leverage as possible for the custody battle."

You know way too much about her "other" men and their finances and her ipad and all the other stuff she allegedly has going on.

If this is about the kid and the divorce than focus your energy on that, yeah you may feel slighted beacuse you "brang" her here but hey SH*T HAPPENS.

Leave the immigration stuff alone, you said a child needs his mother and that is true, she has amongst other things emotionally moved on from you.

Try to come to a common ground with her for the childs sake, and go about your life as she already has.

As one poster stated earlier you may or will be viewed as a disgruntled ex husband going through a divorce from a adulterous wife.

Chalk it up to the game, and move on!

Please clarify if this was ROC (I-751) or citizenship (N-400) interview. Was she told it was recommended for approval? I understand you are upset and she should not have lied, but if I were in your shoes I would let the process go through. Once she has her citizenship, your obligations under I-864 end, although it is not likely she would end up on state assistance if she has a well-paying job.

Why do you think she would move back to the Philippines? Especially if she gets her US citizenship?

Are you still living together, or separated physically?

Legal separation is different from just living apart.

YES it does. If she just had her conditions removed there is no way there has been enough time to apply for and have had a naturalization interview. Period. It does need to be clarified because depending at what stage she is at it will have consequences as far as his daughter goes if he chooses to report her for lying. Whether you like it or not we need to know for sure where she in in the process. Grow up and stop arguing
