question about divorce papers

hi guys! i wanna ask something.

my fiance had two marriages before. the problem is he could no longer locate the divorce papers of his first marriage. he said he didn't know where to get another certified divorce papers. how and where can he get another certified divorce papers since the termination of his first marriage was 1998?

is it ok if we just mention in the forms his second marriage since we cannot provide the certified copies of the divorce of his first marriage? will the center know that he has two marriages before?

please help. thanks.

Timeline

He can obtain a certified copy of the divorce from the clerk's office where the divorce was finalized. He will need these for both divorces.

Yes they will find out and your case can be denied for not being truthful. Have him go back to the court house where he filed for the divorce. They should be able to help him.

No they wouldn't be DENIED. They would receive a request for further evidence which would delay the case.

I don't know about the state your fiance lives in, but here in Georgia all divorce papers stay on permanent file in the county courthouse where the marriage took place.

Since I don't live in my hometown anymore I called my daughter that still lives in the same county and she went to the county courthouse and asked for a certified copy of my divorce papers.

She was out the door in 30 minutes with the certified copy.

First, you donot need the entire divorce decree, you just need a statement from the courthouse he was divorced stating that his marriage is disolved. Its a one sheet paper. Another resource, I am not sure what state you live in, but you can goto http://www.vitalchek.com/ and get certified marriage, divorce, birth certificates, death.... They charge a small fee to get records for you, and in some states send the certified documents to the state to get apostilled for you as well.

11/14/06 - I-130 Petition filed and approved

12/08/06 - First interview - we cancelled - shot ourselves in the foot for this!!!!

01/23/07 - 2nd Interview was cancelled due to Adam Walsh Act

02/13/07 - Sonya recieved her 5 year B-2 Tourist Visa

02/21/07 - Sonya arrives in America

02/26/07 - We are told of new interview on 3/8, but she is in america

03/08/07 - Cancelled interview, Sonya is in America

04/16/07 - Fly back to Ukraine

04/25/07 - FINALLY!!!! LOL Interview and VISA approved!!!

04/27/07 - VISA delay due to Sonya's name misspelling - Embassy typo in database

05/02/07 - Called DOS Washington - name check cleared for Sonya - but

told us no VISA was approved for daughter

05/03/07 - Embassy says VISA printed 5/2, but we caught that they forgot VISA for daughter

and the courier entered wrong address to mail VISA - SO MANY TYPO's & MISTAKES :(

05/08/07 - VISA YEAH!!!! FINALLY!

05/23/07 - Back to America - Well almost - Airlines messed up and sent daughters ticket to Chicago

05/30/07 - They finally made it!!! :)

07/03/07 - Green cards recieved

07/06/07 - Applied for SS card at local office, DS-230 application lost

2/19/2010 - Everything is great!!! We now live in South Carolina - Sonya has applied for her citizenship!! She attends USC for her BSN. Her mother has made 3 trips to US.

I would mention the first marriage as well. Have him contact the courthouse where he got divorced at and they will send him a copy. My mother needed a copy of her divorce decree and she did the same thing - it cost her $5.

I had my fiancee's divorce papers with me but they didn't even wanna see it for some reason.

*Came to visit me in Germany for New Years 2006

*Filed for K1 Visa on 4/4/06

*NOA1 - 7/6/06

*I-129F NOA2 Approved - 9/14/06

*Came to see me Thanksgiving week in Nov. 2006

*K1 Interview - 2/2/07

*K1 Visa received - 2/11/07

*Date of US Entry (POE Chicago)- 3/5/07

*Wedding/Marriage - 3/17/07

AOS (My case was expedited due to husband going to Iraq):

*Filed for AOS - 4/20/07

*Found out in the beginning of June that husband is going to Iraq

*NOA for I-485 - 6/11/07

Really?

The clerk in our county does not issue such 'one page' statements that a marriage is terminated. That's what the decree is for.

I wouldn't suggest using certification of documents from some website that pedals them in place of actual certified documents when dealing with immigration.

You should read the paragraph on the I-129F regarding penalties. You may be fined up to $10,000 or imprisoned up to five years, or both, for knowingly and willfully flasifying or concealing a material fact or using any false document in submitting this petition.

Ok there is a lot of discussion (borderline arguing) about multiple divorce decrees. The second marriage is proof that he was legally able to marry the second time, however the Embassy still request proof of termination of all marriages. I do not know whay the latest divorce decree is not sufficient?

To dispell the myth, it does not have to be a certified copy of the divorce decree, just a copy. Copies can be obtained from the county court house the divorce was finalized in. Some have websites that you can order them online for a fee of course but others do not. I had to send a money order to the court hosue and pay not only for the copy, but for the return envelope.

People have been RFE'd for official records not being certified. Just so you know what has happened anecdotally.
