Filing on my own ASAP and need advice re evidence

Hi guys I'm filing asap and im finalizing the last bits of evidence to send off so if you could tell me if you think that would be enough I'd much appreciate it.

First of all Im still waiting on my divorce papers to be sent to me from the courts that will finalize the divorce, even though my card expires at the end of March and I wanna file asap, should I wait for the actual papers because a lawyer told me all id need to provide would be the waiver of notice to request entry of a divorce decree which I signed in November.

Also some help on a cover letter that I will be writing on my own would be amazing if anyone had any help.

Heres what I have....

* Copies of divorce papers waiting for it to be finalized.

* Copy of Green Card

*Copy of driving license

* Copy of check card, bank acc number, insurance card and dental card

*copies of my paystubs from my first job where we both worked

*Copy of our bank statement from credit union that has both our names

*letter from health insurance in my name

* letter from opticians with my prescription

*letter from dermatologist to me with our address

*letter from USPS changing address letter but says my name only

*copy of utility bill from new apartment showing rent due, with both our names and new address.

*cable bill with my name and our new address.

*another cable bill in my name but our new address,

*letter from her employer to me about new health plan i would be on

*annual pass to theme park signed by her in our names

*paystub from new job in FL where we moved.

*copies of valentines cards from her and birthday cards from her parents

*love letter from her on our wedding anniversary

*copies of ticket stubs from concerts we were at

*multiple family photos showing us and parents on vacation and out and about and us on dates etc

*photos of christmas*

*3 letters/affidavits from people who knew us before and after we were married.

Thats all i have, do you think that would be ok?

I dont have copy of tax returns as her mother did that for us, and when my wife left me her and family cut off all contact with me so im literally doing this on my own. thats why Im unsure of what to put in the cover letter also...

Please help guys

ok. Youre being a bit confusing here...

I see in your other thread you wrote-

the lawyer I was talking with before who sorted my green card in the first place advised I wouldnt need a lawyer again to file this form, he also said I wouldnt need to wait for the divorce to be finalized I could send in my papers saying that its waiting to be finalised.

The user who answered you there answered you correctly before. They told you- you can send in your papers saying the divorce was started and not finished yet- BUT and its a big but. BUT they wont complete your case until they have the final decree. Which is why the lawyer told you to wait to send in your papers in around now.

oops I hit enter and posted it and wasnt done yet... Sorry...

So, you need to file before your 90 day window closes. If you dont have the decree when its time to submit your ROC its not a big deal. Mail it with out it and they will send you an RFE for it.

You just need to figure out the timing of it. You say you have until March. When do you think you will have the papers by? (there are procedures if you dont have the papers in time for the RFE as well, but to make things the smoothest its best if you can time it so you 1-send in the packet w/o the final decree and then 2-by the time you get the RFE you have the papers in hand to mail back with the RFE)

also whats up with all this 'new address' in your description list? some say our address- some say new address.

I see that you posted something along the lines of you moved back to Ireland. Thats a mmmm one. Technically youre in a gray zone there. Permanent residency means you permanently reside here- in the US. You never want to say anything like I moved out of the US. Temporarily traveled out of the US. Sure. For work? Sure. But you always have to have a permanent home here.

Not to be a kill joy but did you keep an address in the US? When you separated from your spouse what did you change your address to? and when did you change it? Did you use a friends address? Because you stated she filed for divorce in May... So what does your DL say? when did you change it? do you have a current lease now? Are you back in the US? I mean you dont have to answer these questions. But there are just so many questions. Its hard to sort through your evidence and evaluate it with out knowing what you are referring to. If you could make it more specific. You know-

example

letter from dermatologist to me with our address (dated Jan 2012 previous marital joint address)

*letter from USPS changing address letter but says my name only (may 2012 changed from marital address to studio appt in next town)

You should probably file your 2014 taxes and submit them with your packet/ Technically they are not due until April and wouldnt need to be in the packet- but because of the fact that you were out of the country- submitting them will help establish you feel US is your residence./They may even ask for them if it passes April and you have an interview. (not sure) I personally dont see any reason to wait on filing taxes- I mean whats going to change if you file now or wait a few months?- but if you cant file now or dont want to- then dont.

I'd hold off on filing anything until mid-March. That way you can submit copies of filed tax return and possibly have some sort of status update on divorce decree.

I should have the decree any day now, I was told I should have it within a month and that was the end of November...

New address means, me and my wife moved from PA to FL, so there are documents that have our old address and docs that have our new address, some with my name only some with both our names.

I have a US address and always have....

I'll edit my evidence on here to be a bit more clearer to what I have....

So the general opinion is wait till I have the divorce decree even if it will be cutting it close to the end of March date?
