HI

My wife currently has her h1 approval notice from her current company.

She is at present in india. She does not have the h1stamping on pasport because her company does not have any client projects.

1) If she quits, does she loose h1.

2)f she quits and come on b1/b2 visa to usa and then apply for h1 jobs using her curent approval is that ok . ..as new employer can starte the process to change in their name. I am told that she is not going to be subject to any cap as she already is having approval notice.

  12. 12/22/2015- Initial RFE for Birth Certificate- uscis asking to submit non availability BC.
  13. 01/03/2016- EAD/AP Card Approved.
  14. 01/05/2016- Received EAD/AP Card in Post
  15. 1/12/2016- Submitting Birth certificate

I ma be wrong but I know you can transfer a H1b but assumed you had to have it first, she does not have the Visa. Sounds like her Employer just stalled, no idea how long you can stall.
