Police Certificate for Mom

What if the police certificate has an arrest record on it? Will that hurt the petition in anyway?

It was a very small minor offence, that occured in 1998. Using illegal electricity.

Please help! I am very worried!

What did it say on the record? has it been dismissed?

Well, you have to prepare a written explanation about the case and what's the status of if now.

The offense may or may not affect the decision because it all depends on how you will explain it and how the consul will accept it.

This should be fine. It's a minor offense. Just mention that she paid a fine and will never do it again.

Cases such as drug related, crimes, murder and other major offenses are big problems.

Just make sure it is well explained on the letter and other supporting proof.

The certificate does not contain much of explanation about the case. It will probably show the offense she made.

Do you have the police certificate on hand? Because sometimes, police certificate does not put any minor offense. If it does not contain it, then NO NEED to say she had an offense. She has a clean record.

If it says on the police cert that she made an offense about so and so... then write a separate letter explaining the offense, if it was dismissed then get a letter or court hearing record that will support your letter that the case is dismissed and that she paid a fine.

Maybe you need to wait for the police cert and see what it says. If it didnt mention anything about it, then why worry? You have nothing to do.

Just do the other steps when it shows the offense.

2 things:

Required to disclose your past criminal history which she obviously has

Provide a police certificate which may or may not include all of the above

Sounds like she will need the full court disposition, the issue is if it is a CIMT. Theft usually is.

So even though she paid the fine at the police station and served no jail time. She needs a court disposition?

She never went to court or was asked to go to court, so i don't understand what needs to be done. :(

This is so frustrating and agonizing right now.

Varies by Country, she was fined and it appears on her record, I used Court because that is the usual name for a body that would do such a thing.

This is so frustrating and agonizing right now.

As I have said, you need to wait for the police certificate first and see what it says right there.

Then, if the offense shows up on your police certificate, then its time to write an explanation.

Keep the receipt of the fine that was charged. You will need that to support your letter that the case is settled with a fine. Maybe in your country, such cases doesnt go to court and a fine will settle the offense. Other countries, cases like that can also be a criminal offense, and in your case it is NOT since no court and no jail time was given.

You will be stressed reading comments from other people from different countries because some things really doesnt apply to all of us since we come from different countries.

She is more than willing to explain what happened. Do you think she will be denied entry into the US because of this?

Can she write a letter explaining the situation to NVC and the Embassy?

I was thinking since she paid her fined that the embassy will pardon her, being that it was so long ago and she has never had any other problems with the law.
