I got a checklist of AOS on January 6 from NVC. The two points we are asked to correct are presented as follows.

[x] Items 13.a.1. The income you enter must match the total (gross) income reported on your most recent

Federal income tax return. If you filed Form 1040EZ, use the adjusted gross income instead.

Part 1 Information on the Household Member

[x] _____TSEGAYE TADESSE____________'s income indicated on line 11 of the I-864A does not correspond to that shown on the most recent tax return and W-2(s).

The AOS was filed by my parents, I-864 by my mother and I-864A by my father. The thing is that they have always been filing the tax return jointly so you cannot tell from the tax return their individual income but rather their total (sum) income is stated. However their W2 form shows their individual income and it was that that they have filled in the form though we got a checklist for that. Therefore, what I want to ask is which number should be supplied in the AOS, the total sum of their annual income as stated in the tax return or their individual income or ?????? Please help me on this as this is so confusing!!!!!!! Please let me know if you want to help me but want more information. Thank you so much!

The mistake that most people make (including my parents as well) is entering the Adjusted Gross Income instead of the Total Income. The amount you enter on the I-864 depends on what kind of tax form the person filed. If they filed a regular 1040, then they should enter the Total Income from line 22 on the 1040. If they filed a 1040EZ, then they should enter the Gross Adjusted Income which I think is on line 37 of the 1040. My parents also file jointly (a regular 1040), so I they filled out an I-864 and I-864A, but father got confused by the instructions and entered the Adjusted Gross. Now we got a checklist and have to wait an additional 60 days for that tiny mistake.

Thanks u very much for your fast reply. Out of the two one of them is the petitioner, in my case its my mother and father will fill form i-864A. What i don't still understand is when each of them fill their part, do they fill in the sum of their individual incomes as stated in the jointly filed tax return? Thanks in advance!
