Dear all,

I hope some one here knows the answer to this tax related question:

I arrived in the states on Jan 15th, and we married on Feb 26th.

My wife is asking me to find out her filing status regarding her new W2 at work. What does shes choose? Married Filing Jointly or Married Filing Separately.

What is best for our situation?

How do you plan to file your taxes for 2006? jointly or separate?

Are you asking what to put on the W4 for withholding this year?

How do you plan to file your taxes for 2006? jointly or separate?

Generally filing jointly is always more beneficial and results in a lower tax bill. Unless you know of some issues where you absolutely need to file seperately, you should assume that you will be filing jointly...

We'll keep researching the W2 question.

Even though I am not working yet (no EAD) and we only now about to file our AOS, do I still have to file income tax return?

The W4 is just used to determine how much they will withhold from your income for taxes. It doesn't tie you to a specific filing status when you actually file. If you both have sizeable incomes, it might be wise for one or both to complete the W4 in such a way as to have more withheld if you need to in order that you don't end up owing a large amount at the end of the year.

You can get a general idea of what your taxes will be by determining what you estimate your 2006 joint income and deductions will be and applying the 2005 forms. You can elect to change the W4 again if you see that too little or too much is being take out when you get your pay statement.

You can file jointly even if only 1 of you has an income.
