i got my RFE letter today - they are asking for a copy of the marriage certificate. I am 100% sure i provided this document in my original submission - and it was an original certified copy...not just a copy of the original. i'm glad they are asking for something that is easy to provide - but it is frustrating that our case is being delayed because of something that they should already have.

i got my RFE letter today - they are asking for a copy of the marriage certificate. That is incredibly frustrating. I have a feeling I'll get an RFE too, and to know now that it could be for something I've already provided to them makes me even more anxious about it. My biometrics appt is on the 18th. I'm assuming you don't get RFE's until after that part is completed.

I would love to be working right now!!! Going a little crazy watching all the potential jobs go by.

We got the RFE notification on 2/6 and the biometric appt was yesterday, 2/12. so it is possible to get an RFE before the biometric appointment. i was able to send back another copy of the marriage certificate yesterday - so hopefully everything will be back on track next week. apparently the 90 day timeframe for receiving the work permit and AP will start over whenever they receive the RFE info. hopefully my husband will get an approval by May. he is going crazy not being able to work!

We got the RFE notification on 2/6 and the biometric appt was yesterday, 2/12. so it is possible to get an RFE before the biometric appointment. i was able to send back another copy of the marriage certificate yesterday - so hopefully everything will be back on track next week. apparently the 90 day timeframe for receiving the work permit and AP will start over whenever they receive the RFE info. hopefully my husband will get an approval by May. he is going crazy not being able to work!

What do you mean apparently? Do you know for sure if the 90 day time frame starts over? Or have you just heard about it? That's such a bummer if it's true. Our status just changed to RFE. Waiting to see what they want. :( This process is very disheartening for honest people who just want to start making their lives better.

if you get an RFE on your EAD - then i believe it is certain that the 90 clock will restart when they receive the requested data. however, i have not been able to find a definitive answer (on the USCIS website) on the 90 day time period restarting if you have an RFE on the 485. The majority of posts that i've read here on VJ say that an "initial evidence" RFE on the 485 will restart the 90 clock for EAD/AP once the support is received. so while i'm not 100% certain, i lean more towards thinking it will restart the 90 days since all 3 applications were sent in as an application "package". but i guess we'll see what happens.

we got our RFE letter within 5 business days - so hopefully you'll get yours this week and get it taken care of as quickly as possible!

Just introducing myself to my fellow January AOS filers. Sent in my AOS/AP/EAD on Jan 20, NOA from Jan 26, and got my biometrics notice last week. I go for biometrics in downtown Boston on Feb 19th ...fingers crossed there are no more snow storms between now and then so I will be able to get there. :)
