In my view,I think they are doing this all wrong.First,the boy's age(8yrs old),there is question mark why a tourist visa. And even if a visa were to be issued,who is going to accompine him to the USA, I dont think any airline will allow a child at that age to travel by himself(I maybe wrong).The best thing to do now is for you to visit the boy,meanwhile apply form I-130 as dependent,though may need biological mother's permision to come to the USA permanently.

Most airlines DO allow children to fly alone, you just have to pay an extra fee for the airline staff to escort the boy on and off the plane and the parents will have to show ID, etc to pick him up at both ends.

And why would they apply for an I-130? The son is coming to visit only. There is no intention for him to move here?

1/30/15 - FINALLY got a reply to my email to remove the attorney from the DS-261

3/9/15 - Called NVC and they have checklisted us for an "incorrect" decree absolute from the UK, even though it is the legal official document. Have requested a supervisor review.

4/28/15 - Called and NVC said supervisor had reviewed and now claimed that the decree absolute was not included. After disagreeing with the less than helpful lady on the phone, and her not being able to get the review time right. (She kept changing her story between 42 days and 30 days).

4/30/15 - Sent the same copy of the decree absolute to the NVC from the UK, highlighting the "decree absolute" wording with a letter stating that this is the only document provided by the UK government.

5/6/15 - Scan date for checklist received.

6/5/15 - Case complete!!!

6/12/15 - Called and interview is scheduled for July 1!

6/14/15 - Received email with interview date and instructions.

6/19/15 - Case showing as ready on CEAC.

7/1/15 - Approved at interview!!!

7/6/15 - CEAC changed to Administrative Processing

7/7/15 - CEAC changed to Issued!!!!!

7/10/15 - Passport and packet delivered!

7/29/15 - Husband entered with visa at Dallas/Fort Worth airport

9/29/15 - GC delivered!!!

5/4/17 - ROC packet sent via USPS

5/9/17 - Tracking shows delivered

5/17/17 - Check cashed

5/19/17 - NOA1 received with date of 5/8/17

5/27/17 - Biometrics appt received 6/8/17

Without the Mother both filing and traveling with the boy, he probably won't be allowed in the US until he is 18 and can apply on his own. Having the Mother with him is his proof of returning home. Being under 18, he really has nothing else that shows that and his chances are slim.

Like some mentioned before... I would wait for a few months, then have the mother and son apply together for the visa.

I think the mother applying also will cost us more money and be even worse here is why.I spoke with her and she told me that the consul kept making faces when she was asked if she was married before to my now husband.She said they were never married.So the interviewer said HA but he DID marry a US citizen? we figured out that most likely the reason they denied the visa for my stepson,was that they thought he married me for his k1 and now wants his son to come on a tourist visa as well as later the mother .This is ridiculous because we have a 3 year old son together,our marriage is more than truthful,and she is now with another boyfriend and has a 2 year old daughter,but she didnt mention that at all because she wanted to limit her answers to what was asked.

I really dont know how to proceed,we were told we should also just send a letter of invitation for my stepson,saying we want him to come for 1 month,go to disneyland etc and that there is no intention of him coming to live. He DOES live with his mother after all,we just dont know how to prove to them!

I doubt if you can, being realistic your Husband will need to be the one doing the travelling.

You have quite a few things going against you, and you can of course apply as often as you like. May be if his home situation improves but on paper i can see it looks weak

To file for a tourist visa for a child & its not summer-time

or maybe Christmas is a red-flag , add to dad being here

214(b) stands, acting over anxious and going back there

quickly is a waste of money...approaching summer mom

can apply for her and kid, with her showing strong ties to

her job, bank statement, lease/mtge, and other responsibilities

she may have there

Let along changing planes, and getting through P.O.E. at the destination airport.

But, I have heard some airlines offer a sort of "chaperon" (mis-spelled that I'm sure) type of travel for extra pay.

Korean Air offers this service, I know for a fact.

As many members have said here, the mother and boy should both apply, then arrange an airline take care of the 8 year old traveler.

Yes airlines do this. I was an UM (unaccompanied minor) but it was free of charge. I have to tell you though. My brother and I had the time of our freaking lives. I was 12 he was 8. We were tended on hand and foot. 1st class lounge or business (which ever is better equipped) while we waited. To top it off, free upgrades if there was space!

If you apply that logic you are better off locking your children at home considering playout outside isn't safe either. Just saying.

The airline would not have an issue with that, they just have someone of their personnel fly with him.

And they are not planning on bringing the boy over permanently, they just want him to come visit as the boy lives with his mother and goes to school in his home country.

I just stumbled upon this - I can't respond with experience but:

Have you checked with a lawyer regarding this? From what I know with most tourists visas you need the letter of intent, round trip airplane tickets (yes that sucks because you have to pay in advance, from previous friends who did this had to pay a bit more for cancellation tickets), a signed letter that is notarized from the mother that the child is approved to go and will return back home after his travels. Also any other means of showing he's returning back (i.e. he has enrolled in the next school year, he has enrolled in sports...ect)

Unfortunately, for an 8 year old boy it's very hard to explain he has 'ties' to Argentina that would enable the CO to believe that this is what will happen. The other posts may be right that unfortunately he may have to wait to come to the US as it becomes very tricky to prove, given your current situation. It's an unfortunate situation but you don't want to create a situation where they NEVER allow his son to come over because of perception he will stay in the US.

Lawyer cannot help and buying a ticket is a really bad idea.
