ok shortly i will have to fill out a I -134 form for my girls K1,,,now here is the thing,,all i really have is a good paying job at 50k a year,,,no real assets,,no savings,,only a checking account with a average balance of $500,,,i rent a house from my uncle so i dont have a morgage....i was thinking maybe a life insurance plan to make it look better but my lawyer says dont worry about it......any ideas on what i could do it make it look better???,,,i hear the consols in manila difficult and will deny you for anything

I can't say anything about the Manila consulate, but overall there does not seem to be a need to prove you have a savings or assets if you earn 50K.

I also have a sufficient enough salary and therefore only included my life insurance along with my savings.

Maybe someone can give you specific advice though on your consulate, or you could e-mail them.

You only need to have enough income to exceed 125% of the federal poverty guidelines. You can find these guidelines here: http://aspe.hhs.gov/poverty/06poverty.shtml

Your $50K should be fine unless there are a lot of people in your household (don't forget to factor in your new wife and any kids that she might bring with her).

If there are other obligations, such as child support, that could play a role also.

Our Timeline

08/03/06 -- Met online, have chatted almost every day since then

09/29/06 -- Met in person at the Lima Airport. 10 wonderful days together.

10/31/06 -- I-129F mailed to TSC

11/09/06 -- CSC cashes the check

11/14/06 -- NOA-1 Received

11/16/06 -- We get 11 days together in Arequipa (Betty's home town). I meet her family for the first time.

12/28/06 -- We get 19 days together in Arequipa. I'll be back in February.

01/18/07 -- Touched! First sign of life.

01/19/07 -- 12:10 AM, NOA-2! APPROVED!!!!!!!!!!!!! On to the next step.

01/19/07 -- Touched again, around 11 AM. I guess we're on the way to the NVC!!

Your income level more than meets the requirements, no need to show bank statement data unless your income level falls below 125% of the poverty line.

EVIDENCE OF SUPPORT. You should be able to demonstrate that you will not become a public charge or be a burden on the U.S. taxpayers for financial support. Submit your petitioner’s most recent U.S. Federal income tax return (Form 1040) and wage statements (Form W-2). Employment letters stating salaries and bank statements may be included. A completed I-134 Affidavit of Support Form will be useful to the consular officer to evaluate your petitioner’s ability to be financially responsible for you.

The I-134 instructions don't refer to any minimum income - only the I-1864 does so it must just be an assumption on everyone's part.

I-134 Instructions:

As the sponsor, you must show you have sufficient income and/or financial resources to assure that the alien you are

sponsoring will not become a public charge while in the United State.

Travel.State.gov states:

Do the same income requirements apply to all immigrant visa applicants even if they use the I-134?

No. The 125 percent minimum income requirement, the need for the most recent year's tax return and other requirements only apply when an I-864 is needed. Applicants using the I-134 will need to show that their sponsor's income is 100 percent of federal poverty guidelines as required under Section 212(a)(4) of the INA

I'm glad someone pointed this out, as I keep seeing the 125% being used in association with the I-134 when it is supposed to be 100%.

Also, household size is considered you and any dependants you have, so you don't count people living in your home who do not rely on you for support, you only count yourself and dependants and the beneficiary.

Doesn't your laywer care about his family? (Of couse, maybe he's rich and doesn't need it..) I think this would be a good idea, some inexpensive term life would be good if you can qualify. (Very important coverage to have IMHO, especially if you dont have alot of other assets, and not just to make your I-134 look better).

I'm glad someone pointed this out, as I keep seeing the 125% being used in association with the I-134 when it is supposed to be 100%.

While indeed one needs only to meet 100% of US poverty guidelines for I-134, for those going through Manila Embassy, our petitioners need to meet the 125% up front since it's only a matter of 3 months before petitioner needs to submit the I-864 at AOS time. Manila Embassy is very strict about this and they seldom accept co-sponsors.

You refers to the I-864 which is a different affidavit of support from I-134.

In I-134, there is no requirement to reveal # of people in household or outright requirement that your income must exceed 125% of poverty guideline.

Although, there is possibility that certain embassy requires certain minimum income as mentioned by Patiently Waiting.
