Scottish citizen living in Canada, applying for US K-1 visa...help!

I have a similar situation: my fiancé is from Australia, living in Canada on his Working Holiday Visa. His visa is good through 2016... does anyone know if we can complete the process (interview and everything) while he is living in Canada or will he need to go back to Sydney

That should not be an issue, generally Consulates will not deal with people visiting that country. Resident there is usually not a problem.

If the visa process will be done before his working visa expires then he is fine to interview in either Vancouver or Montréal.

it really depends on when you file, and the time, timing, schedule, calendar and logistics with the service center that processes the I-129F, NVC's backlog on handling I-129Fs, and Montreal's backlog on allowing you entry into the queue for chasing a K-1 visa.

Study that stuff here at visajourney.com - folk write about it ALL THE TIME,

then

draw yer own conclusions,

make yer own calendar,

and go forth.

Or not. you choose.

FWIW - getting a casefile transferred from 1 embassy to another, takes 3 months if the casefile already arrived at an IV Unit, or 2 weeks if the casefile is still at NVC.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

Same situation for me too. My fiancée is in Canada on a student visa for the past 2 years. We are hoping to do the interview in Montreal instead of having her fly back. FYI; I asked a lawyer about this and his response was:

"If you requested Canada, they should interview her in Canada.

There may be some confusion in the process about that."

11/25/2014 I-129f mailed to Dallas Lockbox

12/04/2014 Receipt NOA 1 via email

12/10/2014 Receipt hard copy NOA 1

12/24/2014 Receipt NOA 2 via checking website

12/26/2014 Receipt hard copy NOA 2

01/20/2014 On hold for ONLY 30 min, got our case# MTL 1234....

02/10/2014 Called NVC (4 times in 3weeks) no update. Checked website in afternoon, IN TRANSIT?!!

02/11/2014 READY. After 21 days of no activity our status magically jumped 2 levels in less than 24hr.

Emailed MONTREAL-IV-DV@STATE.GOV requested further communication via email.

02/17/2014 Got an email response from MTL "Your file is being reviewed. We soon provide you instructions."

03/04/2014 Submitted multiple inquiries with no response! Tired of waiting around, so emailed in Packet 3 with copy of student visa.

03/09/2014 CEAC Status Date changed AGAIN to today. Hope this mean we'll be getting Packet 4 soon.

03/11/2014 GOT PACKET 4! CEAC Status Date changed.

04/17/2014 Interview appointment.

Ok so I am a French and I have been living in Canada for the past 2 and a half years (first with a student visa and now with a temporary work permit). I applied for the K1-visa here in Canada as I knew my work permit would still be valid until I would be interviewed (I had my interview last Monday and got it approved by the way!!! :D So I will be soon with my Fiancée OMGGG!!! :D).

So it is not a problem for you to apply here in Canada if you are legally living here even if it is only on a temporary visa (student visa or work permit or whatever BUT NOT as a tourist of course because that does not work).

The only thing you have to make sure is that your visa will still be valid the date of your interview since they will ask for it this day. Also, they will ask for a copy of this visa when the consulate will receive your case and actually they will not send you the packet 3 until they will get this copy because they need it to update your case so what I can recommend here (I do not know if it works because I did not do it in my case) is to join a copy of your visa with the form I-129F (even though it is not require at this step) cause like that maybe they will not ask for it and will directly update your case when they will receive your application from the NVC and so maybe you will be able to avoid an extra 1 to 2 weeks delay as it happened to me... ;)

And for me you made the right decision by choosing the UK embassy so you avoid any extra work or delay by asking them to transfer your case... ;)

My fiancé is a German living in Canada, but he has Permanent Resident status there, so he'll be interviewing in Canada, so we were kinda in the same boat at first.
