Thanks everyone for an advices. Now he say that he will responsible and do what he should do and he will pay for the baby $500 per month, Anyway it just the words...

If there's have a choices, I would like to the baby to be a citizen. I only have health insurance and it doesn't cover about pragnancy. I don't know if I can buy it. It is possible if I will change the visa to B-1 around April or May this year and I can stay in US ?? maybe2-3 months after the baby born, which probably until November or December

You can get Medicaid for your pregnancy.

You will not be able to change to a B-1 visa to stay in the US. A B-1/B-2 visa is for visiting the US. It is not for living in the US.

All you have is the father's promise to provide. There is no way to legally enforce a promise. You need a written agreement where he acknowledge the baby is his and he will pay $500 in child support.

What is your plan after the baby is born? You can't stay. What will you do if the father will not give permission for you to take the baby home to Thailand?

You need to get real professional help. Go get a lawyer. Go to Catholic Charities for free help. This is about you losing your baby. There are very serious consequences for you and your baby depending on how you approach your situation.

You need to make the decision if this is about protecting your baby or your desire to immigrate to the US. Which is more important?

IMHO, this is your best plan. Get his CO involved to help. Get a DNA test BEFORE the baby is born to determine paternity. Go home to Thailand to have the baby. Use the DNA test and other supporting documents to get a CRBA for your child to establish US citizenship at the US Embassy in Thailand. If the father wants custody, he will have to go to a court in Thailand which is unlikely to give him sole custody and allow him to take the baby to the US.

If you have the baby in the US, you could end up losing custody of the baby because the US court will favor the baby being here. You will have no means to stay in the US once your visa expires. You could end up returning home alone.

Gather San Diego is a lot closer to the border than Wisconsin, but they sure deport the fathers here.

Our social services department takes car of all this legal stuff, hitting the father of the child first with legal action. If the mom is under 18 years of age, have the grandparents act to handle all those expenses. But again, every state has different laws on this subject.

States really don't have any immigration rights, feds are suppose to handle this. And our Department of State has different agreements with every different country.

Feel its best to get legal help on this issue, but this can also be a problem if you get a poor attorney. Have to get good recommendations or contact your state bar to learn about the bad guys. It does get complicated.

Questions may be raised by getting pregnant with a US citizen while here on a visa. Just saying, be prepared for this.

No, there will not.

Someone on a J visa can be here for several years. Are these people not allowed to live? No sex with US citizens? For two years?

Perfectly normal for people here to get pregnant on a visa.

My aunt got pregnant while vacationing in Greece on a visa. No questions were ever raised by any government.

That's true but it's also true the the op's situation is not exactly one of happiness and bliss. She doesn't need to take the pregnancy to term if she can't care for her baby. For all we know she'll have to return home and taking a child along might not get her a ticker tape parade exactly.

One thing for sure with DNA proof, the child would be the offspring of a US citizen and therefore will have rights to US citizenship. Sure make an issue of place of birth, either way regarding the status of the mother, if born here, will be a US citizen.

In my experiences in dealing with the USCIS, only dealing with one person, weird, for any other type of certification, met with a board where a vote is taken. In this issue, too many unknowns involved with the circumstances. And a lot depends upon the person you are meeting with.

Sometimes it helps to have legal representation, finding the right competent one can be a problem. Even in social services, can meet an agent that is in favor of termination and the next one will do everything in their power to protect the right of that child.

Just don't know until you try.

Can I take the DNA test without the father? And if after I go back to Thailand can I use the DNA proof to the US Embassy to ask the citizen for my child?

It's impossible to do the DNA test without the father. How would you prove a link to a US citizen father without a sample of his DNA?

In that case, unless you want an long and expensive battle in court, go home, have your baby there, forget about your boyfriend and go live your life and be happy.
