My fiancee, Tera, has tried several times to ask USCIS for information and every time she is told something different - they don't even know their own procedures. Now we turn to the good people of VJ in a bid to settle our concerns - who better to ask than people going through - or have been through - the same process, right?!

Few questions:

Is the original petition sent to the US Embassy, or will I need a copy for the interview?

Submitted petition in September, including Affidavit of Support forms. Will I need new - updated - Affidavit forms or copies of the original Affidavit?

Is the Affidavit form valid for six months?

It asks for 50mm x 50mm photos with the DS-156 forms (two copies). Are standad passport photos Ok for this? And are they sent with the forms, or just taken with me to the interview?

Thanks all!

Congrats on receiving Packet 3! Once your petition left the SC, USCIS won't have any information for you, so don't bother with them any more.

The petition is sent to the embassy, but you should have a copy of your entire I-129F petition, including ALL originals.

I believe the I-134 must be notarized, so I would bring the original of that as well.

Take the passport photos with you to the interview.

Good luck!

USCIS does not deal with petitions once they are approved and fowarded from the NVC. At that point you are dealing with the US consulate so you need to direct your questions to the appropriate place.

You won't normally need a copy of the original petition at the interview, but many people take one to be safe. The affidavit of support is never submitted with the original I-129F petition. You will need whatever affidavit your consulate requires. That information would be provided to you by the consulate, or on their website.

To echo and further clarify what others have said: after you get the NOA2 and the app gets passed on, it is no longer in the control of the US Department of Homeland Security - it moves over to the US Department of State - two totally different beasts that don't necessarily know what the other is doing. On the bright side, by all accounts, State is far better to deal with and this chunk of the process moves more quickly.

Or so sayeth the VJ flow chart.

relliky2d,

First of all, you do not need the entire I-129F petition. If the Embassy does not have the appropriate forms and accompanying documentation from USCIS, they will not process the Visa.

Ideally, the I-134 affidavit of support should be as fresh as possible. The one you propose to use is over 5 months old, perhaps 6 months by the time they see it. I would draft a new one, if I were you.

Photos required are 2"x 2" (50mm x 50mm), color. Use that type.

The photos are generally to be submitted with the forms. Check with the Embassy/Consulate applicable to your case, to be sure.

Thanks for all your input.

I've managed to get my 2x2" photos (I got six for £4.99 from Klick). I'm going to send two off with the DS-156 forms and take the rest with me to the interview, just in case.

On the guide in Packet 3 it says not to sign the DS-156 ("Please complete but do NOT sign the form"). I presume this is because I will need to sign it at the interview in front of the officer? Do I need to date it, or not? Also, do I date and sign the other forms (DS-230 Part 1, DS-156K and DS-157)? As it does not mention either way.

Appreciate all your comments.

Apparantly we do not have the originals of the petition - the originals were submitted.. Is this a big problem??

Should the I-134 have been submitted initially or just take with me to interview? I'm really confused.

Please answer above questions if you can help.

The originals specified aren't the original petition, it's originals of the copies of documents you submitted (i.e., birth certificates, proof of relationship, etc.).

Take the copies. It's unlikely that you will need anything from the original I-129F petition application at the consulate as they will already have your complete file.

No affidavit of support is ever submitted with the original I-129F application to USCIS. It is submitted to the consulate based on their requirements and normally that list is included in the interview packet sent out by the consulate.

Perhaps you should start by checking out your consualte's website and their requirements of a K1 interview as well as the guides here:

Thanks kitkat1 & misa.

I have packet 3 and it requests Evidence of Support (I-134). So if we initially submitted it (notorized), will we need to do it again or just take a copy to the interview? As it is valid for 12 months.

It doesn't matter if you initially submitted it - it was not part of the requirements of the I-129F petition and probably went directly into a garbage can.

It is required for the interview, get an up to date copy as William33 suggested:

Ideally, the I-134 affidavit of support should be as fresh as possible. The one you propose to use is over 5 months old, perhaps 6 months by the time they see it. I would draft a new one, if I were you
