Hi,

I have a bit tricky situation here. I dated my x spouse for about 3 years before i tied the knot. Married in 2009, apply for GC in 2010 and was approved in Apr 2010. Went through 4 hours interview :( . However, she cheated on me and got pregnant 5 months after the marriage. We separated for about three months. I thought i was strong enough to give her divorce and go on with my life. Turns out i was not that strong. I forgave her and got back with her. My name is not child birth certificate. The reason i know that child is not mine because we always had protected sex. We started living together again and everything was going smooth. I tried to conceive child with her in 2012 but was not successful. We tried for about 5 months and doc told us some couple tries for couple of years before taking any further action. In 2013, she cheated on me again while i was planning trip with her to London. I went for 751 interview alone and told the officer that i am not with my spouse any more and going to file the divorce. He was nice and didn't deny my application and and asked me to refile the i 751 waiver. He asked me to withdraw my application instead. I went under depression for few months and could not think straight. My job was on urge of letting me go due to lack of performance. In 2014, i filed the waiver application and have interview on Jan 15. Below are the documents i sent along with file.

Electricity Bills

Her Social security number showing that she inherited my last name

Bank account bills from 2010 - 2013

Dental plan

My 401K listed her as Bene

Life Insurance listed her as Bene

Emergency Contact at my Job

Sworn affidavits from her Brother and Mother and few of out Mutual friends

Receipt of Engagement ring

House Lease from 2010-2013

Divorce decree

Any help would be greatly appreciated. I told everything in Cover letter i sent to the USCIS about how our relationship lead to Divorce. I really don't know what to expect in the interview. I know my situation is more complex but that is the truth.

You got 4 hrs AOS interview and went through, then you should expect more this interview. Good luck.

It was more or less for about 4 hours but we held our ground. I was not nervous or anything since i didn't have anything to be scared of. I am just looking for little more advice. Even now, i am not nervous or scared or anything. Just though get some input since i always read from this forum and get help. This is the first time posting my own situation. However, thanks for your reply.

Just be honest. And try to get affidavits from anybody who knows both you. If you have any evidence of her cheating , take it with you and show it to the interviewer, like chatting records, emails, etc.

I never went through her emails or phone . I never thought she would cheat on me again especially when i took her back do and the reason i took her back because i believe everyone deserves the second chance. After i found out that she cheated on me again, i was no longer interested in her or her business anymore. However, i have affidavits from her friends and my friends. Affidavits from her mother and her brother as well.

Hi,

I cant really say if it went well. It seems like it was 50/50 chances. He wanted to see pictures which i didn't have a lot. Since my ex wife took it all. I answered all the questions he asked without hesitation. The fact that my ex wife had a baby with someone else while we were married was little suspicious for him. He said that he would need to look at my file and if i am approved than i will get my green card soon or if deny i will receive letter.

It was 30 mins interview

1 Where did you met

2 Date of Marriage

3 Date of Divorce

4 Date of Separation

5 Dating period time.

6 Questions about her Family

7 We moved to three different locations within four years. Questions regarding that.

8 Little bit about the baby.

Asked me if i was ever arrested before.

Question about my job etc.

This is what i can remember for now. I will post more once i remember.

i guess the fact that your wife became pregnant with someone else child and you decided toforgive was rather out of the ordinary. ordinarily that marks the end of the marriage.obviously it may be argued that the forgiveness was out of commitment..but that is not what people generally do. With the other evidence, that fact may be irrelevant as far as determining motive at start of marriage so i think you will be fine.
