That's funny, because I called yesterday as well and was told "our system is down, call back later" by a Tier 1. She sounded kind of lost though, so I have no idea if she was telling the truth or was just feeding me a line of BS. I plan on calling back today and not taking no for an answer.

By the way, do you know what the "official" reason for your expedite was listed as? It was my understanding that you have to choose one specific reason, and then provide evidence supporting why that reason is applicable to your case.

The official reasons I cited were USCIS Error and Financial Loss. Those are two of the acceptable reasons. Now the question is whether they will agree with me. Having waited for the "normal processing time" to pass, I think USCIS error ought to be legitimate. They screwed up by not doing the work on time.

If my request for an expedite gets declined, then I intend to file a Writ of Mandamus lawsuit. I've noticed that many attorneys use this with success, but you can also file it yourself (Pro Se).

So I called TSC today which is my first call in months, and the lady tells me at least another 2 months to hear anything about our case, well I filed June 30th 2014 and got my NOA1 first week of July 2014. I ask her to transfer me to a Tier 2 and she ask me what did I need to ask them? I said I want to be transfferd to a tier 2 please to ask what is going on with my case. She proceeds to tell me that they will only give me the same information that she gave me, I said fine let them give me that please transfer me. What the heck is going on, now they are the gate keepers??????

I get that this is a long process but can you be honest with me about it don't piss on me and tell me its raining!!!! She says that TSC is a little behind and that they are just processing apps from May 6th what the hell correct me if I'm wrong weren't they doing those back in October 2014? All I am saying is this give people straight answers! i am contacting my State Rep in the morning, this is ridiculous!

I just called them this morning and got some generic answer that was of no help to me. The guy seemed almost irritated that I was questioning the system and wait times. I explained to him that if they are in may, why are cases from late June being accepted? This is driving me crazy. According to him I'm under normal processing times. I'm considering contacting my state rep also.

The embassy may be slow, but I really don't give a . There are plenty of couples who filed and married after we filed, and we're still waiting for NOA2.

I have seen quite a few Phillipine-based cases that open and close within 4-5 months, start to finish. Yours specifically took 5 months for everything. Quit acting like Phillipine based filers have any idea what non-CSC non-Phillipine based filers go through. Please, just stop. If I am very, very lucky I will barely be getting my NOA2 in 5 months. You and most Phillipine based cases have everything completed by that time.

I was wondering what "normal processing time" was? Seems to not be a definitive number of days on this.

Do you have a list of "acceptable reasons"?

My fiancee has a 4 yr old son, soon to be 5 (so to be my step-son!). I never knew the effect it would have on him as he sees me fly in for a couple of weeks every 3/4 months and then doesn't see me for 3 months except for over Skype. I don't think he's quite grasped how big the "pond" is!

Have you thought about trying to contact the senator?

About the writ of mandamus...you've certainly done your homework! Good for you. Glancing over the steps listed in the thread you linked to, the problem I see is that it takes a few months, best case scenario. (One of the steps refers to a 60-day wait for the government's response, plus the time it takes to get all the paperwork together and mail the documents.) By then, there's an excellent chance that you would've received your NOA2 already and the lawsuit would lose its purpose. Also, since it's specific to your case, I doubt it would have any benefit for future filers in our position (assuming TSC continues to fall further and further behind). Seems like the "best last resort" would still be contacting your congressperson(s).

The way people are being treated in the system, whether at USCIC or the NVC is nothing short of a complete disrespect for the individual and their loved ones. We have been working on getting my South Korean stepdaughter to the US since she was 16 and she turned 18 last month and is still tangled up at the NVC since September. We jumped on every step in the process paying the fees and filing the documents within days of being able to do so.

Yesterday I received a letter in the mail telling me they we received the email change for her that they requested over 60 days ago that was submitted the same day we received the request even though there was nothing wrong with her email supplied previously. They say they need another 60 days to look at it after taking over 60 days to find it. These people must go home at night proud how they are messing with us and our loved ones! And worst yet... nobody cares in Washington that is able to improve upon it! While the NVC claimed they were staffing up last year, things continue to get worse according to the statistics on this site. Oh but wait, California announced hiring 800 additional staff members to process licenses for illegal immigrants who have not every filed a form or paid a dime in fees!

For God Sake we are talking about a young lady who needs her mother and our support who has been approved by USCIS (after 11 months) and a case without blemish caught up in a system that has no care for human dignity!

When we filed on August 4th, the normal processing time was 5 months, per the USCIS web site. That page seems to have conveniently disappeared after they redesigned the site. TSC was running at six months, but that is BEHIND the normal processing time. Some USCIS agents will try to convince you that it is the "new normal." It isn't. When I spoke yesterday, the guy used the word "behind" and I reminded him that word means it is abnormal to take so long. He couldn't argue his way out of that one. They know they're running behind. Don't let them tell you otherwise.

As for contacting my senator, I haven't done that yet. I contacted my Congressman's office a couple of months ago and it was assigned to some junior numbnuts who had no concept of his task. All he would do is inquire and take whatever BS excuse that USCIS gave him. He didn't push, he didn't help. He was useless. I tried to get some other staffer at the Congressman's office, but it always ended up back talking to the useless kid. Complete waste of my time.

From what I've read, Congress and Senate have no authority to get USCIS to do anything. They can only inquire. Hell, I can do that much.

The Writ may take months, but so does waiting. Better to go ahead and file it. Maybe it will help if USCIS doesn't process quickly. Maybe it will be useless if they do process our petition soon. For our case, I don't care what motivates them to do the work. I just want it done. If I wait to file the lawsuit, then those are days that could've been part of the waiting period for the suit.

The link that I posted is a few years old, but she claimed results in 30 days. There are some immigration Q&A sites where I've read that attorneys frequently do this for immigration clients with positive results. Based upon my experience with my Congressman's office, I think this has a better chance of result than trying a senator. Maybe I'll try both.

All I want is to move this along to bring my fiancée home.

wbeem You are so correct in regards to the State Rep, I contacted my state Senator last week sign the document and they said "They will let me know when they hear from TSC" What kind of mess is that. I ask him about the Phillipines being expedited and he acted like no such thing was happening. I said yes ok then If wait is what we have to do then so be it, but just tell me the truth don't feed me a bunch of bull!

We phoned USCIS last week and were told to phone back at the 5 month line so looks like the 5 months still exists even if not on their website.

They said then they would look into a transfer to local office insinuating Houston, though I'm not sure if she was was right as would Houston local office be trained on 129f forms?

In any case the process is the process, as frustrating as it is,I think the CSC .processing time is more the problem as it's unfair and surely it's simple to transfer TSC cases to CSC, maybe the goverment/senators should push for that, there must be someone who have oversight of the processing times of all USCIS offices?

I don't want to discourage you, but when you call back after 5 months, they still tell you that you are within normal processing time. Why? Because their utterly useless, poorly updated system says that they are currently processing May 6th petitions. So, if you filed after May 6th, this is the ####### you are going to be fed until your date of filing falls beyond what their system says, even although what it states is relevant as at 2.5 months ago. Telling you to call back within x amount of time or at any given point is simply USCIS's way of glossing over their inadequacies and fobbing you off.

I've checked the last 10 people getting approved here on the forum and they seem to have been waiting between 190-200 days. So at least that somewhat gives us an idea of when we might get approved.

I also checked today. It a heck of a long time to wait to be with the person you love. Some days we feel stronger than others. Today, for me, is one where every moment away from him feels like an eternity :(
