I130/i485 question about parents.

Hi friends

I have a question to which I couldn't find an answer to. Hopefully some more intelligent people here can help me out. I am planning to file I-130/I485 for my mom who is here on VWP, I was wondering when I file for this, can she leave the country and come back in case of an emergency or she has to be here till she receives her green card ?

Also when you file co-currently do they approve straight for green card or they still approve I130 and you have to still wait another few month so they can process I-485 ?

You help is much appreciated.

If you are a US citizen then you can file for her at any time. Be aware that since she is adjusting from the VWP then there is no appeal should her application be denied.

If she files for an EAD (on an I-765) and AP (on an I-131) then she can both work and travel internationally approximately 90 days after filing. If she departs the US before her AP is approved then her application will be deemed to be abandoned.

When filing an I-130 and I-485 concurrently then they are adjudicated concurrently by the local office either at the interview or after it.

Just wondering do you have to pay extra for EAD and AP other than I-130 and I-485 and also if I am filing concurrently do I add fees for both I-130 and I-485 ? once again thanks for your reply.

EAD and AP have no charge when filed with or after an I-485. You do pay the I-130 and I-485 fees though.

Do I make 1 total check for I130/I485 or 2 checks ?

It doesn't matter either way, though I would suggest two separate cheques.
