This isn't so much a question but advise for those SS couples going through the AOS process who are having their civil unions converted into marriage. Not sure if anyone else has had an issue but we got a RFE as the USCIS office handling our application didn't recognize that we had been married within the 90 days of the K1 visa. We had. We were in a civil union performed in Illinois. When we returned to get married our previous civil union was converted into a marriage licence. The new marriage license states now that we have been married since the original date of the civil union. Hence why the USCIS officer looking at our paperwork may have incorrectly assumed that we didn't get married. I resubmitted our original civil union certificate, our new marriage certificate (highlighting both dates which indicate the date of our civil union and the new registered date of marriage), as well as a letter explaining it all. They have acknowledged that they have received all of this and so far we haven't received another RFE. Fingers crossed.

Curious if the converted marriage date now indicates you were married before the visa? Just wondering if they are questioning a fiancé visa as valid to somebody married (on the certificate) a while back.

Sorry to take so long to reply to this. Yes, it caused a RFE...converting marriage date. We were told we would qualify for K1 visa as we didn't get married in the 90-day window because the date on the marriage license predated the 90-day window.

Had to send back new copies of both the original civil union certificate, new marriage license, and a letter explaining it all. I also highlighted all the dates on both certificates as new marriage license does have two dates on it. The date of the original civil union and new date as recorded marriage. They accepted that and were happy. We went on to receive travel and work permits as well as no interview letter. Just waiting on green card.

Sounds confusing. Is the new date of recorded marriage the same as or different from the civil union date?
