This question is about my sister. Her fiancee is going to the Philippines next month and he asked how to file a K1 visa with my sister's daughter. My sister's daughter is 2 yrs old. Does he need to file separate petition? What form that he needed to fill out? Thank you...

With the K-1 it is very simple. For the petition process, I-129F, list the child in the section specific to the children of the fiancee. Once the petition is approved and the case file is sent to USEM it will allow for a K-1 & K-2 visa.

Tell your sister's fiance to :guides: easily accessible at the top of the VJ forum page. In particular, the K1 visa guide: http://www.visajourney.com/content/k1guide. In addition, tell him to read the DOS Nonimmigrant K1 Fiance(e) FAQs: http://travel.state.gov/content/visas/english/immigrate/types/family/fiance-k-1.html Those two links have very good information about K1 and K2 visas.

Tell him that at the initial I-129F petition phase to be sure to include the child's information where requested on the petition. There will be more documents/applications required for the K2 at the consulate interview phase of the process.

Good luck on their immigration journey.

Completed: K1/K2 (271 days) - AOS/EAD/AP (134 days) - ROC (279 days)

He will just fill out the I-129F, then put the name of the child? I uploaded the form is that correct? Does the child need also form G-325A? If he will only file the I-129F, so he will only pay $340 for just one petition?

Yes complete 16a++ - Child 1 of Alien Fiance.

No G-325A for the child, just you and your fiance complete the G-325A. And only pay one fee of $340. Follow the GUIDE here on VJ http://www.visajourney.com/content/k1guide

Everything from this point forward will have two actions.... one for the K1 mother and one for the K2 daughter. So section 16A will contain the K2 Daughter. Always two fees $240 plus $240 so your fee total is $480 payable at BPI, and most times two documents. Here is the updated instructions.
