I called AT&T and asked for the phone records for my calling card. On my cell and land line phone records it only shows the calling card number on the bills, it doesn't even say international call. So the phone company told me to contact the long distance provider, so i called AT&T. They said they would need a subpeona to release those records to me. Where do I get one and how long will it take?

5/7/2007- APPROVED!!!

5/17/2007- called uscis...APPROVED MAY 7th!

5/21/2007- NVC received packet

5/23/2007- NVC forwards package to US Embassy in London

6/19/2007- London received packet 3

6/25/2007- Received paper NOA2

6/27/2007- Received packet 4

7/16/2007- Medical at 2:10pm

9/4/2007- Interview London 9:30am...APPROVED!!!

11/11/2007- Wedding date

AOS

12/3/2007- Sent I-485

12/8/2007- Delivered and signed for

12/12/2007- NOA's for all 3 (hard copies received on 12/17)

12/26/2007- Transferred to California

1/3/2008- Biometrics notice in mail

1/31/2008- Biometrics exam 3pm- USCIS Touch

2/2/2008- AP approval and notice sent

2/7/2008- Work card ordered

2/9/2008- Received AP in mail

2/11/2008- Email confirming Work Approval Notice/ Received Work Card

3/26/2008- Finally, a touch :)

3/27/2008- Yet another touch...

7/14/2008- Permanent address registered and welcome packet sent

7/17/2008- I-485 Approval Notice sent

7/21/2008- Received resident card!!!

If you know any detectives I would ask them. They do stuff like that during investigations. They can probably point you in the right direction. Good luck!

I didn't know if the phone records were something that should be sent with my initial packet or something that i should get only if they send me an RFE requesting them. If they're not important i won't worry about them. I'm just trying to get as much evidence as i can just in case.

I didn't know if the phone records were something that should be sent with my initial packet or something that i should get only if they send me an RFE requesting them. A consulate specific issue.

But even where they are required they would only be for the interview and you are a long way off that.

A subpeona is an official order from a court of law demanding something be produced. You will likely need the help of an attorney and it will be a lengthy and costly process. It may also be unneccessary.

First - phone records are not the most important "primary evidence" that you need to send with your I-129F forms. You must show evidence that you have met w/in the last 2 years in person. That's best done with passport stamps, boarding passes, and some dated photos. Even photos, along with phone records, emails, etc, are "secondary evidence" that, by itself, doesn't convince the government that you met.

Second - the company's response that a subpeona is necessary may not even be true. I would suggest you find a website or phone number for the Utilities Commission (or whatever oversight body might operate in your home state) and contact them to find out. Laws can vary by state and federal laws may also apply.

Keep in mind too that lots of people would have the same sorts of phone records and reviewers now or later in the process when the date might be more relevant will have experience looking at such things. You could always attest to their meaning and validity in front of a notary and have a signed letter go with them.

Again though - they are not the only, nor necessarily even good evidence to be presented. So don't stress.

5-29-07 Packet 3 returned, few days later than planned due to bank holiday weekend

6-06-07 Medical in London (called to schedule on May 29)

6-11-07 "Medical in file" at Embassy

6-14-07 Resent packet 3 to Embassy after hearing nothing about first try

6-22-07 DOS says "applicant now eligible for interview," ie: they enter p3 into their system

6-25-07 DOS says interview date is August 21

6-28-07 Help from our congressional representative gives us new interview date: July 6

7-06-07 Interview at 9:00 am at the London Embassy - Approved.

7-16-07 Visa delivered after 'security checks' completed

I-129F approved in 111 days; Interview 174 days from filing

Since the phone records are of no significance to the petition then you have plenty of time post petition filing to do something different if you choose than what you are thinking.
