State ID Illinois regulations & the K1

We went to the DMV to get a state ID with the following itmes :

1. Passport

2. SSN

3. Birth certificate

4. Proof of residency / address

5. Printed I-94 (valid until Feb 21)

The manager told us that my husband ( he came on a K1) can not get a state ID because " he must have a visa that has a 6 month validity" !

Of course the K1 expires at POE entrance and the I-94 is valid for 90 days, period.....and of course they are clueless about this.

There is no other DMV branch nearby to hunt for DMV humans that knows what they are doing.

The K1 / I-94 does not FIT their new 6 month rule.

I can't go higher it seems like because it was the manager/superviser who we dealt with.

Any other suggestions from anyone having dealt with this ? Is there an online regulation that I can print and take with me that mentions

the specifics of a K1 as exception to the rule ? The guy gave us a paper stating what was needed (we had everything) and the 6 months rule was not

printed on that paper about the requirements. The only option we have is to file a complaint on the DMV web site.

The above is the only requirements I can find online and we meet those but the manager said there is a 6 months visa validity rule which is not

listed anywhere online or on the paper he gave us.

I had the same issue here in Nebraska. I decided to wait until my EAD came through, which has a longer validity period. The DMV would only give me until the date shown on the I-94 and said that I would have to pay again for a renewal when my EAD came through... So decided to wait

We have not filed yet and wanted the ID for other identification purposes so we will try again, maybe another person will be there instead.

It just ticks me off when their web site says one thing and in person there are strings attached to the regulation and they aren't printed.

In the District of Columbia you have to prove six months or more of remaining legal presence, which is why I encourage my exchange student friends to get a local ID / driver license as soon as possible. It sounds like Illinois is the same and the DMV website doesn't do a good job of explaining it.

I'm in Rockford and had the same problem. I decided that I would wait till I get my EAD cause like you said the website or flyer they give you doesn't state anything about time spent in the US. Keep courage, this too shall pass

i just got my state id here in michigan,and same with you i brought all the paper that you brought also,and the reason why they cant give me state ID because my I-94 will expire on Feb 1 and because i filed aos already,the lady told me to wait the I-485 notice of action or I-797C Then come back,so we did came back with the I-797C and they got my photograph paid 10 dollars and told me that i will receive my State ID within 2 weeks..hope it will help? We went to another location and that representative interpreted the regulations differently and we were issued an ID on the spot.

I then added him to utility bills and my bank account. Now on to AOS !

My Wife and I just tried to get her a state ID this morning at the Des Plains, Sec of State office and were denied. The woman basically said she needed to have her green card. She also mentioned that a K1 visa is only valid for 90 days when I showed her the I-94. We had her Philippines passport and birth certificate, her SSN card, the I-94 form, our marriage certificate, a few letters from USCIS with her current name and address. I told her we are going through the process and our next step is the AOS interview where we need to prove our marriage and such. We need an ID or driver's license to add her to my bank account and other things. We are stuck where we can't get one without the other.

Illinois state lists on their web site acceptable identification documents, one being under Group B the " I-797 Notice of action status change"

so you should be ok once you receive the NOA1 from filing AOS.

We did not file yet but since some representatives are confused about their own regulations you should try to visit all in your area and hope to hit

the jack pot like we did.
