Hi,

I have a special situation. At least I think that way.

My son is a US Citizen. He is a minor diagnosed with severe Autism. Last year we moved to India because our GC got denied. Meanwhile my son did not get any adequate health care. As a result, his health got regressed.

I just like to know if there are any provision in the law where there is an exception that Parents can get Green Card and move back to US to help him with his therapies and take care of him?

I am open to knowing my options and suggestions are welcome.

Until your son is old enough to petition for you, there is not a path to a green card through family based immigration (unless you have other family).

Why was your green card denied? Is the son's father a USC?

How did your son acquire US citizenship? Was he born in the US?

Your son needs to be at least 21 before he can petition you for a green card. You have no other family-based route at this time.

There is no greencard provision for this; if there is a specific short term therapy you want him to have (Horses for Healing, teaching you ABA techniques), then you could try for a B2 tourist visa but considering the denied greencard and the USC son, it may be difficult to get.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

You do not get turned down for an Employer Sponsored GC without knowing why.

Not sure that this is likely to be a situation where the child is likely to be able to sponsor parents post 21.

Find it hard to beieve treatment is not available in India.
