Happy new year and How are you all?


My Name is Bhumin. Right now I am an international student in Canada. When I came here I am single and after six months I applied for USA B1/B2 Visa and I got my visa to visit USA. After that I went to USA and got married with my girlfriend. She is a green card holder So she applied for I-130 petition for me.


Its been one year since we are married and I went 3 times to visit her in USA but every times when I cross border I said I am going to visit my friend never mention about my wife.


Every time I stay there couple week and come back in Canada. Now my question is " Is there any problem in future about this I mean when my F2A file open and during interview will I face problem?".


And Last my priority date is Nov 22 2013 and I think it will become current around Augest 2015 and I am planing to go USA in April 2015 permanently. So can I transfer my interview in USA?


Guide me about this case.

There's a difference between not volunteering information and lying. Or to put it another way: I hope your wife is your friend, otherwise you have a very unusual marriage.

Were you asked if you were married and said no? If so, that's a problem. If you were simply asked the purpose of your visit then it's probably not a problem.

You cannot enter the US on a nonimmigrant visa (such as a B-2) with the preconceived intent to remain and adjust status though. If you happen to be within the US for a visit and your priority date becomes current, that's one thing, but intending to move here would be quite another. Since you are the spouse of an LPR then you must remain in status all the time until you filed as well. Even just a single day of overstay would render you ineligible to adjust status.

Thank you for reply.

I never lied about anything. I just gave the information about what they asked and every time they only asked general questions like purpose of visit, where you going, how long you stay there,..etc that it.

And I m going on b2 visa to visit my friend(wife) and if they give 6 month i-94 than i stay there for 6 month and if priority date become current I stay there otherwise i will come back after 6 months

Then you're taking an extended vacation here, rather than moving here.

Tell CBP you are moving here when they ask the purpose of your visit in April on a B-2 and they will turn you right around back to Canada.
