B2 to adjustment of status

Hi ,

i am going to appluy for adjustment of status next week hopefully. Right now i am on B2 visitor visa. What would be my status after applying. My b2 is valid till juley. looking forward

As soon as you have applied for AOS, your status will be "pending adjustment". Remember that you cannot work or travel without explicit authorisation and documentation from USCIS during that period. Once you have adjusted you will be a Conditional PR if you have been married for less than two years, or an LPR if you have been married longer than that.

If you apply for an AOS based on marriage out of B2, your status remains ... well, you know, I don't think I know the official term, but you are legal. You essentially are a "pending status change", I would think.

Once you apply for the AOS, though, be aware that you cannot leave the country without an AP (advance parole; travel document/I-131) approved for you.

You are correct in the first statement, wrong in the second.

Change of status and adjustment of status have distinctly different meaning when talking about immigration.

And clmarsh beat me to the punch, but she's got it in essence:

o To work, you require: I-765, approved (EAD/employment authorization document)

o To travel outside the US, you require: I-131, approved (AP/advance parole).

Those are crucial.

Thanks. one thing else. Am i be given some document while on 'pending adjustment" , I mean letter proof

You will receive:

I-797C -- these are basically your "notices of action". They are issued to confirm that USCIS has received your package and generally how long it takes, when you're due for a biometrics appointment, when your interview is done.
