hi guys. long story short, i arrived in America on oct 30th, 2014, on a k1 visa. the stamp in my passport says the visa "expires" on january 27th of 2015. i got married beginning of november but i still have not sent in the aos application yet. my question is, is it too late to still send it in? i mean logically id say no but at this point i got to be sure so im asking you, even if this sounds stupid lol. and if i were to send it in a few days, do i include an explanation letter stating as to why it took so long for me to apply or is that not something i have to do?

No, technically you can apply for AOS at any time. No explanation needed. What matters is that you got married within 90 days. However, in order to be allowed to travel and work (and in many states, also to get a Driver's license), you should apply for AOS/EAD/AP as soon as you can. Good luck!

Submit AOS docs when you can. Everything that led up to doing that is forgiven. No letter because it doesn't matter.

The only real problem you have is not being able to do many things that are connected to the green card.

There are 2 important dates with a K1 , the expiration date is only important for entry to the US. Once you enter it is no longer of any meaning. The next is that you marry within 90 days of the day you entered. You can file AOS anytime after you marry , must recommend sooner than later so you establish a green card and can work or travel

This will not be over quickly. You will not enjoy this.

There is no time limit/deadline in which to file for AOS. As long as you married within 90 days then you are eligible to file based on your approved I-129F petition and fulling the requirements of the K-1 visa. However, you will be out of status and begin to accrue unlawful presence between your I-94 expiring and filing for AOS. Once you file for AOS, you then enter a period of authorized stay while waiting for your green card approval.

You file the same as anyone else, no matter when you file. Since there is no deadline and you are eligible to file, no explanation needed.

guys, i still have not sent in the aos papers, mostly because i didnt have enough money up until now. i had my co-sponsor fill out and sign her papers at the end of november and i filled out some of mine too then, so ive got some documents filled out with that november date on them, so what do i do? do i fill them all out once again and put newer dates on them or can i just send in the papers with date for end of november? my k1 expires on the 27th of january so in 6 days....now, do i send it all in BEFORE the 27th? (still got to have photos taken etc) or it doesnt matter if i send it in after the 27th in case i cant get it all done before then?

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

it's still not too clear for me. i would like to know if i can still send it all in even after the 27th of january which is the day my l-94 expires. there are questions in the aos documents referring to the validity of l-94 and such.

and second question is, do i fill everything out all over again with a newer date or is what i filled out almost 2 months ago still good to send in? i've got my co-sponsor's affidavit of support dated for 2nd of December and some of the documents i filled were end of November.

To be clear, yes you can submit your application after the 27th of January. You only need to be married by the expiration of your I-94. That's it. The I-94 is submitted in the AOS, along with your marriage certificate, to prove you concluded a valid marriage within your 90 days.

The affidavits of support are fine. You would really only need new ones if you file after April 15 (in which tax year 2014 will be required).

Not sure how it was not clear. There is no deadline to file for AOS as long as you married within 90 days of entry. That means there is no deadline, no time limit, no time frame, at all. So yes, without a deadline to file, you could send in your AOS application after your I-94 expires.

Right, ok, thank you. I am asking because I've gotten some forms filled a few months ago and I am not sure if I can turn those in. Like, I have my co-sponsor's affidavit of support form filled out and it's dated dec 02 but I still don't have my husband's filled out so i am just wondering what I should do....do we put today's date on his affidavit or put dec 02 so it matches my co-sponsor's form....I have every other form that I was supposed to fill out basically filled out other than the date because I am not sure what to put there. If i go ahead and put today's date or december's so they all match.
